  2         An act relating to drug abuse prevention and

  3         control; amending s. 893.02, F.S.; revising the

  4         definition of the term "practitioner" to

  5         include advanced registered nurse

  6         practitioners; creating s. 893.0357, F.S.;

  7         providing requirements for an advanced

  8         registered nurse practitioner to apply for a

  9         controlled substance registry number; providing

10         for establishment of such requirements by a

11         multidisciplinary committee; providing for

12         appointment and duties of such committee;

13         requiring the Board of Nursing to adopt such

14         requirements as a rule and to make the

15         determination as to whether an advanced

16         registered nurse practitioner has met such

17         requirements; providing for prior review and

18         approval of changes to such requirements;

19         providing an effective date.

21  Be It Enacted by the Legislature of the State of Florida:

22

23         Section 1.  Subsection (18) of section 893.02, Florida

24  Statutes, is amended to read:

25         893.02  Definitions.--The following words and phrases

26  as used in this chapter shall have the following meanings,

27  unless the context otherwise requires:

28         (18)  "Practitioner" means a physician licensed

29  pursuant to chapter 458, a dentist licensed pursuant to

30  chapter 466, a veterinarian licensed pursuant to chapter 474,

31  an osteopathic physician licensed pursuant to chapter 459, a

  1  naturopath licensed pursuant to chapter 462, an advanced

  2  registered nurse practitioner licensed pursuant to chapter 464

  3  and subject to the provisions of ss. 464.012 and 893.0357, or

  4  a podiatrist licensed pursuant to chapter 461, provided such

  5  practitioner holds a valid federal controlled substance

  6  registry number.

  7         Section 2.  Section 893.0357, Florida Statutes, is

  8  created to read:

  9         893.0357  Advanced registered nurse practitioner

10  application for controlled substance registry number;

11  multidisciplinary committee.--

12         (1)  An advanced registered nurse practitioner licensed

13  and certified under chapter 464 may apply for a controlled

14  substance registry number upon meeting all of the following

15  requirements:

16         (a)  Satisfactory completion of educational course

17  requirements relating to the prescription of controlled

18  substances, as determined appropriate by the multidisciplinary

19  committee created in subsection (2).

20         (b)  Documentation of required experience prescribing

21  medications other than controlled substances, as determined

22  appropriate by the multidisciplinary committee created in

23  subsection (2).

24         (2)  There is created a five-member multidisciplinary

25  committee, consisting of one representative of each of the

26  following boards, appointed by the board: Board of Nursing,

27  Board of Medicine, Board of Osteopathic Medicine, Board of

28  Dentistry, and Board of Pharmacy. Any vacancy on the committee

29  shall be filled in the same manner as the original

30  appointment. The Agency for Health Care Administration shall

31  provide staff support for the committee. The committee shall

  1  meet as necessary to determine, and approve changes to, the

  2  educational course and experience requirements appropriate for

  3  advanced registered nurse practitioners to apply for a

  4  controlled substance registry number for purposes of

  5  prescribing controlled substances. The educational course and

  6  experience requirements determined appropriate by the

  7  committee shall be adopted by the Board of Nursing by rule,

  8  and the Board of Nursing shall determine whether an advanced

  9  registered nurse practitioner has met such requirements. Any

10  proposed changes to such requirements must be reviewed and

11  approved by the committee prior to being adopted by rule.

12         Section 3.  With respect to section 893.0357, Florida

13  Statutes, as created by this act, the initial members of the

14  multidisciplinary committee created therein must be appointed

15  on or before October 1, 1998, and the initial educational and

16  experience requirements for advanced registered nurse

17  practitioners to apply for a controlled substance registry

18  number must be determined by the multidisciplinary committee

19  on or before March 1, 1999.

20         Section 4.  This act shall take effect upon becoming a

21  law.

      For purposes of authorizing advanced registered nurse
  4    practitioners to prescribe controlled substances, revises
      the definition of the term "practitioner," as used in
  5    chapter 893, F.S., relating to drug abuse prevention and
      control, to include advanced registered nurse
  6    practitioners, and provides requirements for an advanced
      registered nurse practitioner to apply for a controlled
  7    substance registry number. Provides for establishment of
      such requirements by a multidisciplinary committee and
  8    provides for appointment and duties of such committee.
      Requires the Board of Nursing to adopt such requirements
  9    as a rule and to make the determination as to whether an
      advanced registered nurse practitioner has met such
10    requirements. Provides for prior review and approval of
