  1                      A bill to be entitled

  2         An act relating to residential real property;

  3         requiring notification of entitlement to

  4         homestead tax exemption; providing a civil

  5         penalty; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  (1)  The closing agent at any transfer of

10  ownership of residential real property shall notify the

11  purchaser of entitlement to a homestead exemption from ad

12  valorem taxes under chapter 196, Florida Statutes.

13         (2)  In addition to any other penalty or remedy

14  provided by law, a purchaser who is injured by a violation of

15  this section may bring a civil action against the closing

16  agent for recovery of actual damages, court costs, and

17  attorney's fees.

18         Section 2.  This act shall take effect October 1, 1998.

21                          SENATE SUMMARY

22    Requires the closing agent in a transfer of ownership of
      residential real property to notify the purchaser of
23    entitlement to homestead tax exemption. Provides a civil
      penalty.
