1 A bill to be entitled
2 An act relating to organ donation; amending ss.
3 322.21 and 732.921, F.S.; reducing the driver's
4 license fees for persons who register to become
5 organ donors when applying for or renewing a
6 driver's license; creating s. 381.603, F.S.;
7 providing certain priority to organ donors in
8 the allocation of organs for transplant;
9 requiring the Agency for Health Care
10 Administration to adopt rules; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (1) of section 322.21, Florida
16 Statutes, is amended to read:
17 322.21 License fees; procedure for handling and
18 collecting fees.--
19 (1) Except as otherwise provided herein, the fee for:
20 (a) An original or renewal commercial driver's license
21 is $50, which shall include the fee for driver education
22 provided by s. 233.063; however, if an applicant has completed
23 training and is applying for employment or is currently
24 employed in a public or nonpublic school system that requires
25 the commercial license, the fee shall be the same as for a
26 Class E driver's license. A delinquent fee of $1 shall be
27 added for a renewal made not more than 12 months after the
28 license expiration date.
29 (b) An original Class D or Class E driver's license is
30 $20, which shall include the fee for driver's education
31 provided by s. 233.063; however, if an applicant has completed

1 training and is applying for employment or is currently
2 employed in a public or nonpublic school system that requires
3 a commercial driver license, the fee shall be the same as for
4 a Class E license.
5 (c) The renewal or extension of a Class D or Class E
6 driver's license or of a license restricted to motorcycle use
7 only is $15, except that a delinquent fee of $1 shall be added
8 for a renewal or extension made not more than 12 months after
9 the license expiration date. The fee provided in this
10 paragraph shall include the fee for driver's education
11 provided by s. 233.063.
12 (d) An original driver's license restricted to
13 motorcycle use only is $20, which shall include the fee for
14 driver's education provided by s. 233.063.
15 (e) Each endorsement required by s. 322.57 is $5.

17 The fees specified in paragraphs (a)-(d) shall be reduced by
18 $5 for persons who make an anatomical gift upon applying for
19 or renewing a driver license.
20 Section 2. Section 381.603, Florida Statutes, is
21 created to read:
22 381.603 Organ donors; priority for allocation of
23 organs for transplantation.--
24 (1) Patients within the state who have been evaluated
25 and listed for solid organ transplantation by a state-approved
26 transplant facility and who are organ donors, as evidenced by
27 the existence of:
28 (a) An anatomical gift donor card;
29 (b) An organ donation sticker or organ donation
30 imprint on the patient's driver license;

1 (c) An organ or tissue donation document properly
2 executed by the patient; or
3 (d) Medical records indicating any past organ or
4 tissue donation by the patient,
5
6 shall receive priority over nondonor patients with the same
7 transplant status, in the allocation of organs for transplant.
8 (2) The Agency for Health Care Administration shall
9 adopt rules to implement the provisions of this section.
10 Section 3. Subsection (1) of section 732.921, Florida
11 Statutes, is amended to read:
12 732.921 Donations as part of driver license or
13 identification card process.--
14 (1) The Agency for Health Care Administration and the
15 Department of Highway Safety and Motor Vehicles shall develop
16 and implement a program encouraging and allowing persons to
17 make anatomical gifts as a part of the process of issuing
18 identification cards and issuing and renewing driver licenses.
19 As an incentive for such donation, driver license fees shall
20 be reduced, as provided in s. 322.21, for persons who complete
21 a donor registration card when applying for or renewing a
22 driver license. The donor registration card distributed by the
23 Department of Highway Safety and Motor Vehicles shall include
24 the material specified by s. 732.914(2)(b) and may require
25 such additional information, and include such additional
26 material, as may be deemed necessary by that department. The
27 Department of Highway Safety and Motor Vehicles shall also
28 develop and implement a program to identify donors, which
29 program shall include notations on identification cards,
30 driver licenses, and driver records or such other methods as
31 the department may develop. This program shall include, after

1 an individual has completed a donor registration card, making
2 a notation on the front of the driver license or
3 identification card that clearly indicates the individual's
4 intent to donate the individual's organs or tissue. A notation
5 on an individual's driver license or identification card that
6 the individual intends to donate organs or tissues is deemed
7 sufficient to satisfy all requirements for consent to organ or
8 tissue donation. The Agency for Health Care Administration
9 shall provide the necessary supplies and forms through funds
10 appropriated from general revenue or contributions from
11 interested voluntary, nonprofit organizations. The Department
12 of Highway Safety and Motor Vehicles shall provide the
13 necessary recordkeeping system through funds appropriated from
14 general revenue. The Department of Highway Safety and Motor
15 Vehicles and the Agency for Health Care Administration shall
16 incur no liability in connection with the performance of any
17 acts authorized herein.
18 Section 4. This act shall take effect July 1 of the
19 year in which enacted.

Reduces driver's license fees by $5 for persons who
24 register to become organ donors when applying for or
renewing their driver's licenses. Provides that patients
25 in the state who have registered as organ donors or
donated an organ in the past shall receive priority over
26 nondonor patients of the same transplant status, in the
allocation of organs for transplant.
