                                          HB 3857, First Engrossed



  1                      A bill to be entitled

  2         An act relating to the City of Orlando and

  3         Orange County; repealing chapter 55-31098, Laws

  4         of Florida, relating to the number of licenses

  5         which may be granted for the sale of

  6         intoxicating beverages therein; providing a

  7         grandfather clause; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Chapter 55-31098, Laws of Florida, is

13  hereby repealed.

14         Section 2.  Upon repeal of Chapter 55-31098, Laws of

15  Florida, new alcoholic beverage licenses for the City of

16  Orlando and the unincorporated areas of Orange County shall be

17  issued in accordance with general law.  Further:

18         (1)  the repeal of Chapter 55-31098 shall in no manner

19  affect, amend or nullify any license issued under the

20  provisions of that act, except that restrictions on the

21  relocation of licenses issued subject to the population

22  limitation, created as a result of different quota ratios

23  within the county, are removed as long as such relocation is

24  in compliance with general law and all applicable local

25  ordinances and regulations.

26         (2)  any application for licensure pursuant to Chapter

27  55-31098 which is filed with the Division of Alcoholic

28  Beverages and Tobacco prior to the effective date of this act,

29  shall not be affected by the repeal and the division is

30  authorized to issue such license if all other requirements of

31  the Beverage Law are met.
