  1                      A bill to be entitled

  2         An act relating to pharmacy; amending s.

  3         465.003, F.S.; expanding the definition of the

  4         term "practice of the profession of pharmacy";

  5         creating s. 465.188, F.S.; authorizing and

  6         providing requirements for a pharmacist to

  7         initiate or modify drug therapy and therapeutic

  8         management; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (12) of section 465.003, Florida

13  Statutes, is amended to read:

14         465.003  Definitions.--As used in this chapter, the

15  term:

16         (12)  "Practice of the profession of pharmacy" includes

17  compounding, dispensing, and consulting concerning contents,

18  therapeutic values, and uses of any medicinal drug; and

19  consulting concerning therapeutic values and interactions of

20  patent or proprietary preparations, whether pursuant to

21  prescriptions or in the absence and entirely independent of

22  such prescriptions or orders; and other pharmaceutical

23  services. The phrase also includes any other act, service,

24  operation, research, or transaction incidental to, or forming

25  a part of, any of the foregoing acts, requiring, involving, or

26  employing the science or art of any branch of the

27  pharmaceutical profession, study, or training, and shall

28  expressly permit a pharmacist to transmit information from

29  persons authorized to prescribe medicinal drugs to their

30  patients. In addition to the authority under s. 465.186 to

31  order and dispense medicinal drugs independently of an

  1  established protocol, a pharmacist practicing under this

  2  chapter may initiate or modify any drug therapy and

  3  therapeutic management which is authorized within the

  4  framework of a written protocol established with an authorized

  5  supervisory practitioner.

  6         Section 2.  Section 465.188, Florida Statutes, is

  7  created to read:

  8         465.188  Initiation and modification of drug therapy

  9  and therapeutic management by pharmacist.--In addition to the

10  provisions of this chapter that allow a pharmacist to perform

11  pharmaceutical services independently of an established

12  protocol, a pharmacist may initiate or modify drug therapy and

13  therapeutic management, including the administering of

14  immunizations, pursuant to a written protocol established with

15  a supervisory practitioner who is a physician licensed under

16  chapter 458 or chapter 459. The supervisory practitioner may

17  delegate to any pharmacist licensed under this chapter the

18  authority to initiate or modify the drug therapy and

19  therapeutic management of the practitioner's patients, but

20  only if such therapy and management is within the framework of

21  a written protocol established between such practitioner and

22  pharmacist. A pharmacist who, pursuant to such a protocol, has

23  accepted authority to initiate or modify drug therapy and

24  therapeutic management under this section must:

25         (1)  Clearly inform the patient that she or he is a

26  pharmacist and that the patient has the right to see the

27  supervisory practitioner prior to initiation or modification

28  of the drug therapy and therapeutic management by the

29  pharmacist.

  1         (2)  Maintain, and keep readily retrievable, copies of

  2  current agreements and protocols signed by the supervising

  3  practitioner and pharmacist.

  4         (3)  Issue the prescription or order in a form that

  5  complies with rules adopted by the board.

  6         Section 3.  This act shall take effect October 1 of the

  7  year in which enacted.

10                          HOUSE SUMMARY

11
      Expands the definition of the term "practice of the
12    profession of pharmacy" to include other pharmaceutical
      services, including certain research, and the initiation
13    and modification of drug therapy and therapeutic
      management under a written protocol established with an
14    authorized practitioner. Authorizes and provides
      requirements for a pharmacist to initiate or modify drug
15    therapy and therapeutic management under such a protocol.
