7 amending s. 288.905, F.S.; requiring Enterprise
8 Florida, Inc., to develop a utilization plan
9 for minority business enterprise and to submit
10 a report of total expenditures resulting from
11 contracts with minority business enterprises
12 for review and approval by the Minority
13 Business Advocacy and Assistance Office;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Paragraph (p) is added to subsection (4) of
19 section 287.09451, Florida Statutes, to read:
20 287.09451 Minority Business Advocacy and Assistance
21 Office; powers, duties, and functions.--
22 (4) The Minority Business Advocacy and Assistance
23 Office shall have the following powers, duties, and functions:
24 (p) To review and approve the utilization plan for
25 minority business enterprise and the report of total
26 expenditures resulting from contracts with minority business
27 enterprises submitted by Enterprise Florida, Inc., pursuant to
28 s. 288.905.
29 Section 2. Paragraph (d) of subsection (2) of section
30 288.905, Florida Statutes, is amended to read:

1 288.905 Duties of the board of directors of Enterprise
2 Florida, Inc.--
3 (2) The board of directors shall, in conjunction with
4 the Office of Tourism, Trade, and Economic Development,
5 develop a strategic plan for economic development for the
6 State of Florida. Such plan shall be submitted to the
7 Governor, the President of the Senate, the Speaker of the
8 House of Representatives, the Senate Minority Leader, and the
9 House Minority Leader by January 1, 1997, and shall be updated
10 or modified before January 1, 1998, and annually thereafter.
11 The plan must be approved by the board of directors prior to
12 submission to the Governor and Legislature. The plan shall
13 include, but is not limited to:
14 (d)1. Specific provisions for the stimulation of
15 economic development and job creation in small businesses and
16 minority businesses. These provisions shall include, but are
17 not limited to, the identification of federal, state, and
18 local financial and technical resources available for small
19 businesses and minority businesses; and specific methods for
20 the use of the resources identified in the plan to meet the
21 goal of job creation in small businesses and minority
22 businesses in the state.
23 2. A utilization plan for minority business enterprise
24 within the State of Florida which shall be developed by
25 Enterprise Florida, Inc. In conjunction with the submission of
26 the utilization plan, Enterprise Florida, Inc., shall submit a
27 report of total expenditures resulting from contracts with
28 minority business enterprises in the state for the previous
29 fiscal year. Such plan and report shall be submitted to the
30 Minority Business Advocacy and Assistance Office within the

1 Department of Labor and Employment Security by September 1
2 annually for review and approval.
3 3.2. Enterprise Florida, Inc., shall involve local,
4 state, and federal small business and minority business
5 development agencies and organizations, both public and
6 private, in developing and carrying out any provisions.
7 Section 3. This act shall take effect upon becoming a
8 law.

11 HOUSE SUMMARY

Requires Enterprise Florida, Inc., to develop a
13 utilization plan for minority business enterprise within
the state as a component of their strategic plan for
14 economic development of the state, and to prepare a
report of total expenditures resulting from contracts
15 with minority business enterprises in the state for the
previous fiscal year. Provides that the plan and report
16 shall be submitted annually to the Minority Business
Advocacy and Assistance Office within the Department of
17 Labor and Employment Security for review and approval.
