  1                      A bill to be entitled

  2         An act relating to a special election to be

  3         held on September 1, 1998, pursuant to Section

  4         5 of Article XI of the State Constitution, for

  5         the approval or rejection by the electors of

  6         Florida of a joint resolution amending Section

  7         17 of Article I of the State Constitution

  8         relating to the death penalty and

  9         interpretation of the term "cruel or unusual

10         punishment"; providing for publication of

11         notice and for procedures; providing an

12         effective date.

14  Be It Enacted by the Legislature of the State of Florida:

16         Section 1.  Pursuant to Section 5 of Article XI of the

17  State Constitution, there shall be a special election on

18  September 1, 1998, at which there shall be submitted to the

19  electors of Florida for approval or rejection House Joint

20  Resolution No. 3505 proposing the amendment of Section 17 of

21  Article I of the State Constitution, which amendment preserves

22  the death penalty and provides for certain interpretations of

23  the term "cruel or unusual punishment."

24         Section 2.  Publication of notice shall be in

25  accordance with Section 5 of Article XI of the State

26  Constitution. The special election shall be held as other

27  special elections are held.

28         Section 3.  This act shall take effect upon becoming a

29  law, if passed by a vote of three-fourths of the membership of

30  each house.
