2 An act relating to driver licenses; amending s.
3 322.16, F.S.; providing exceptions to license
4 restrictions for certain drivers who are age 17
5 or younger; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsections (2) and (3) of section 322.16,
10 Florida Statutes, are amended to read:
11 322.16 License restrictions.--
12 (2) A person who holds a driver's license and who is
13 under 17 years of age, when operating a motor vehicle after 11
14 p.m. and before 6 a.m., must be accompanied by a driver who
15 holds a valid license to operate the type of vehicle being
16 operated and is at least 21 years of age unless that person is
17 driving directly to or from work. The provisions of this
18 subsection shall not apply to any person who maintains a
19 weighted grade point average of 3.0 or better or who has
20 earned a high school diploma or its equivalent and provides
21 the department with proof satisfactory to the department of
22 such grade point average or the attainment of a high school
23 diploma or its equivalent.
24 (3) A person who holds a driver's license who is 17
25 years of age, when operating a motor vehicle after 1 a.m. and
26 before 5 a.m., must be accompanied by a driver who holds a
27 valid license to operate the type of vehicle being operated,
28 and is at least 21 years of age unless that person is driving
29 directly to or from work. The provisions of this subsection
30 shall not apply to any person who maintains a weighted grade
31 point average of 3.0 or better or who has earned a high school

1 diploma or its equivalent and provides the department with

5 Section 2. This act shall take effect upon becoming a
6 law.

Provides exemptions from the provisions of law governing
11 driver license restrictions which are applied to a person
who holds a driver's license and who is under 17 years of
12 age when operating a motor vehicle after 11 p.m. and
before 6 a.m., and applied to a person who is 17 years of
13 age when driving after 1 a.m. and before 5 a.m., if the
person maintains a weighted grade point average of 3.0 or
14 better or has earned a high school diploma or its
equivalent.
