  1                      A bill to be entitled

  2         An act relating to the tax on diesel fuel;

  3         amending s. 206.8745, F.S.; providing for a

  4         refund of tax paid on undyed diesel fuel

  5         consumed by the engine of a motorcoach during

  6         idle time for certain purposes; defining

  7         "motorcoach"; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (8) is added to section

12  206.8745, Florida Statutes, to read:

13         206.8745  Credits and refund claims.--

14         (8)  Undyed, tax-paid diesel fuel consumed by the

15  engine of a motorcoach during idle time for the purpose of

16  running climate control systems and maintaining electrical

17  systems for the motorcoach is subject to a refund as provided

18  by rule. As used in this subsection, "motorcoach" means a

19  privately owned vehicle designed to carry 20 or more

20  passengers, not including the driver, which is used

21  exclusively in the commercial application of transporting

22  passengers for compensation.

23         Section 2.  This act shall take effect July 1 of the

24  year in which enacted.
