  1                      A bill to be entitled

  2         An act relating to governmental purchasing;

  3         amending ss. 235.31 and 287.093, F.S.;

  4         authorizing a county, municipality, community

  5         college, or district school board, in its sole

  6         discretion, to implement a small business

  7         enterprise program which may include

  8         designating contracts for competitive bidding

  9         by small business enterprises; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

14         Section 1.  Paragraph (d) is added to subsection (1) of

15  section 235.31, Florida Statutes, to read:

16         235.31  Advertising and awarding contracts;

17  prequalification of contractor.--

18         (1)

19         (d)  A county, municipality, community college, or

20  district school board may, in its sole discretion, implement a

21  small business enterprise program which may include

22  designating construction project contracts for competitive

23  bidding by small business enterprises, when feasible.

24         Section 2.  Section 287.093, Florida Statutes, is

25  amended to read:

26         287.093  Minority business enterprises; procurement of

27  personal property and services from funds set aside for such

28  purpose.--

29         (1)  Any county, municipality, community college, or

30  district school board may set aside up to 10 percent or more

31  of the total amount of funds allocated for the procurement of

  1  personal property and services for the purpose of entering

  2  into contracts with minority business enterprises.  Such

  3  contracts shall be competitively bid only among minority

  4  business enterprises.  The set-aside shall be used to redress

  5  present effects of past discriminatory practices and shall be

  6  subject to periodic reassessment to account for changing needs

  7  and circumstances.

  8         (2)  A county, municipality, community college, or

  9  district school board may, in its sole discretion, implement a

10  small business enterprise program which may include

11  designating contracts for competitive bidding by small

12  business enterprises, when feasible.

13         Section 3.  This act shall take effect upon becoming a

14  law.
