  2         An act relating to state employment; creating

  3         s. 110.175, F.S.; creating the Florida State

  4         Employee Involvement in Education Act and

  5         providing purpose thereof; requiring the

  6         Department of Management Services to develop a

  7         rule relating to administrative leave for state

  8         employees to participate in education-related

  9         activities; providing definition of the term

10         "education-related activities"; providing

11         procedural requirements for enactment of rule;

12         requiring a report from the Secretary of

13         Management Services; providing an effective

14         date.

16  Be It Enacted by the Legislature of the State of Florida:

17

18         Section 1.  Section 110.175, Florida Statutes, is

19  created to read:

20         110.175  Florida state employee involvement in

21  education.--

22         (1)  TITLE.--This section may be cited as the "Florida

23  State Employee Involvement in Education Act."

24         (2)  PURPOSE.--The Legislature recognizes the need for

25  greater parental and community involvement in the education of

26  children in Florida. It is the intent of the Legislature to

27  require state agencies to establish personnel policies that

28  will enable state employees to balance employment

29  responsibilities with education-related responsibilities to

30  children. It is the further intent of the Legislature to

31  encourage other public and private employers to establish

  1  similar personnel policies to enable more parents and

  2  interested adults to assist in the education of the children

  3  of this state.

  4         (3)  RULES.--

  5         (a)  The Department of Management Services shall

  6  develop a rule establishing policies that permit all state

  7  employees to receive 4 hours of noncumulative paid

  8  administrative leave per month to participate in

  9  education-related activities. The rule shall authorize the

10  head of any state agency, as defined in s. 20.055, to provide

11  administrative leave in excess of 4 hours for employees to

12  participate in such activities. For purposes of this section,

13  "education-related activities" shall include, but not be

14  limited to, parent-teacher conferences, mentoring, tutoring,

15  sponsorship of school clubs, attendance at athletic events,

16  and attendance at or participation in school assemblies,

17  school-sponsored field trips, programs, and plays. These

18  activities or events shall take place at, be sponsored by, or

19  be approved by a public school, private school, or licensed

20  child care facility responsible for the care and education of

21  children from birth through grade 12.

22         (b)  The Department of Management Services shall

23  publish such rule in the Florida Administrative Weekly no

24  later then October 1, 1998, and proceed to adopt a rule

25  without undue delay pursuant to chapter 120. The rule shall be

26  effective 20 days after having been filed with the Department

27  of State and shall become part of the personnel rules of all

28  applicable state agencies 30 days after the effective date of

29  the rule. Any employee or organization representing employees

30  shall be considered a party for purposes of any rule required

  1  by this section, notwithstanding any provision of chapter 120

  2  to the contrary.

  3         (4)  REPORT FROM SECRETARY OF MANAGEMENT SERVICES.--The

  4  Secretary of Management Services shall report to the

  5  Legislature no later than October 1, 1999, recommendations for

  6  modifications of statutes or rules of the Department of

  7  Management Services or of any state agency affected by this

  8  section which are necessary to remove statutory or regulatory

  9  barriers that may affect implementation of any provision of

10  this section.

11         Section 2.  This act shall take effect upon becoming a

12  law.

      Creates the Florida State Employee Involvement in
17    Education Act, the purpose of which is to establish
      personnel policies that will enable state employees to
18    balance employment responsibilities with
      education-related responsibilities to children. Requires
19    a rule permitting 4 hours of administrative leave per
      month for participation in education-related activities.
