  1                      A bill to be entitled

  2         An act relating to jails; amending s. 951.23,

  3         F.S.; providing a criminal penalty for refusing

  4         to obey jail rules and regulations; providing

  5         an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (11) is added to section 951.23,

10  Florida Statutes, to read:

11         951.23  County and municipal detention facilities;

12  definitions; administration; standards and requirements.--

13         (11)  Any inmate in any jail who repeatedly, knowingly,

14  and willfully refuses to obey any rule or regulation governing

15  the conduct of inmates as provided in the Florida Model Jail

16  Standards, pursuant to subsection (4), while being subject

17  thereto is guilty of a misdemeanor of the second degree,

18  punishable as provided in s. 775.082 or s. 775.083, and such

19  punishment must be in addition to the sentence he or she is

20  then serving.

21         Section 2.  This act shall take effect upon becoming

22  law.
