1 A bill to be entitled
2 An act relating to inline skating; providing
3 findings and intent; creating s. 316.2067,
4 F.S.; providing definitions; providing
5 regulations with respect to the operation of
6 inline skates upon the roadways of the state;
7 providing rights and duties of persons
8 operating inline skates; requiring display of a
9 light during specified hours of operation;
10 requiring persons under 16 years of age to wear
11 a helmet while operating inline skates;
12 providing an effective date.

14 WHEREAS, the Legislature finds and declares that a
15 large number of the citizens of the State of Florida
16 participate in the recreational sport of inline skating, and
17 WHEREAS, inline skating provides a wholesome and
18 healthy family activity which should be encouraged, and
19 WHEREAS, inline skating attracts to the state a large
20 number of nonresidents who significantly contribute to the
21 economy of the state, and
22 WHEREAS, it is the intent of the Legislature to grant
23 to inline skaters in the State of Florida all of the rights,
24 and to subject inline skaters to all of the duties, applicable
25 to operators of bicycles as specified in s. 316.3025, Florida
26 Statutes, except where such provisions by their nature can
27 have no application to inline skating, NOW, THEREFORE,

29 Be It Enacted by the Legislature of the State of Florida:

1 Section 1. 316.2067, Florida Statutes, is created to
2 read:
3 316.2067 Inline skating regulations.--
4 (1)(a) "Inline skates" means skates with wheels
5 arranged singly in a tandem line rather than in pairs.
6 (b) "Toy vehicle" means a coaster, skateboard, roller
7 skates, sled, toboggan, or toy upon which a person may ride,
8 and does not include inline skates.
9 (2) A person operating inline skates may not attach
10 the same or himself or herself to any vehicle upon a roadway.
11 (3) Any person operating inline skates upon a roadway
12 at less than the normal speed of traffic at the time and place
13 and under the conditions then existing shall ride as close as
14 practicable to the right-hand curb or edge of the roadway
15 except under any of the following situations:
16 (a) When overtaking and passing another vehicle
17 proceeding in the same direction.
18 (b) When preparing for a left turn at an intersection
19 or into a private road or driveway.
20 (c) When reasonably necessary to avoid any condition,
21 including, but not limited to, a fixed or moving object,
22 parked or moving vehicle, bicycle, pedestrian, animal, surface
23 hazard, or substandard width lane, that makes it unsafe to
24 continue along the right-hand curb or edge. For the purposes
25 of this subsection, a "substandard width lane" is a lane that
26 is too narrow for an inline skater and another vehicle to
27 travel side by side safely within the lane.
28 (4) Any person operating inline skates upon a one-way
29 highway with two or more marked traffic lanes may ride as near
30 the left-hand curb or edge of such roadway as practicable.

1 (5) Persons operating inline skates upon a roadway may
2 not skate more than two abreast except on paths or parts of
3 roadways set aside for the exclusive use of inline skates
4 and/or bicycles. Persons skating two abreast may not impede
5 traffic when traveling at less than the normal speed of
6 traffic at the time and place and under the conditions then
7 existing and shall skate within a single lane.
8 (6) Every person operating inline skates upon a public
9 street or highway must be capable of operating such skates in
10 a prudent and careful manner and of coming to a full and
11 complete stop on such skates.
12 (7) Every person operating inline skates on a roadway
13 during the period from sunset to sunrise shall display
14 somewhere on the front of his person or helmet a white light
15 that is visible to oncoming traffic, and a red light shall be
16 displayed somewhere on the rear of his person. A person
17 operating inline skates may be equipped with lights or
18 reflectors in addition to those required by this section.
19 (8) A person operating inline skates who is under 16
20 years of age must wear a helmet that is properly fitted and is
21 fastened securely upon the skater's head by a strap, and that
22 meets or exceeds the standards of the American National
23 Standards Institute (ANSI Z 90.4 Bicycle Helmet Standards),
24 the standards of the Snell Memorial Foundation (1984 Standard
25 for Protective Headgear for Use in Bicycling), or any other
26 nationally recognized standards for bicycle helmets adopted by
27 the department.
28 (9) No parent of any minor child and no guardian of
29 any minor child may authorize or knowingly permit any such
30 minor child or ward to violate any of the provisions of this
31 section.

1 (10) A person operating inline skates upon and along a
2 sidewalk, or across a roadway upon and along a crosswalk, has
3 all the rights and duties applicable to a pedestrian under the
4 same circumstances.
5 (11) A person operating inline skates upon and along a
6 sidewalk, or across a roadway upon and along a crosswalk,
7 shall yield the right-of-way to any pedestrian and shall give
8 an audible sign before overtaking and passing such pedestrian.
9 Section 2. This act shall take effect upon becoming a
10 law.
