  1                      A bill to be entitled

  2         An act relating to domestic violence; amending

  3         s. 741.28, F.S.; modifying the definition of

  4         "family or household member" for purposes of

  5         determining domestic violence; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Subsection (2) of section 741.28, Florida

11  Statutes, is amended to read:

12         741.28  Domestic violence; definitions.--As used in ss.

13  741.28-741.31:

14         (2)  "family or household member" means spouses, former

15  spouses, persons related by blood or marriage, persons who are

16  presently residing together as if a family or who have resided

17  together in the past as if a family, and persons who have a

18  child in common regardless of whether they have been married

19  or have resided together at any time. The term "family or

20  household member" does not include a child to whom

21  disciplinary action or corporal discipline under s.

22  415.503(9)(a)4. has been applied when no harm arises from such

23  discipline.

24         Section 2.  This act shall take effect upon becoming a

25  law.

28                          SENATE SUMMARY

29    Provides that for purposes of the domestic violence law,
      the term "family or household member" does not include a
30    child to whom disciplinary action or corporal discipline
      under s. 415.503(9)(a)4. has been applied when no harm
31    arises from such discipline.
