1 A bill to be entitled
2 An act relating to water resources; amending s.
3 373.149, F.S.; acknowledging that the South
4 Florida Water Management District is the local
5 sponsor of the Restudy of the Central and
6 Southern Florida Project for Flood Control and
7 Other Purposes; requiring legislative approval
8 of the plan or report that results from the
9 Restudy, before the water management district
10 can take certain actions, expend funds, or
11 otherwise implement the plan; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 373.149, Florida Statutes, is
17 amended to read:
18 373.149 Existing districts preserved.--
19 (1) The enactment of this act shall not affect the
20 existence of the Central and Southern Florida Flood Control
21 District created by chapter 25270, 1949, Laws of Florida, or
22 the Southwest Florida Water Management District, created by
23 chapter 61-691, Laws of Florida, or any contract or obligation
24 of such districts entered into prior to the effective date of
25 this act. The two districts shall continue to exercise the
26 taxing powers authorized to them in the territories within
27 their respective boundaries, except that nothing herein shall
28 limit the department in considering and recommending to the
29 1973 session of the Legislature changes in the boundaries and
30 transfers of funds, appropriations, personnel, property, or
31 equipment between or among the existing districts and

1 districts created by this chapter. The two districts shall
2 continue to exercise the powers presently authorized by
3 chapter 378 and this chapter, notwithstanding provisions
4 contained to the contrary in this chapter, until any such
5 powers shall be specifically revoked or modified by the
6 department pursuant to this chapter, except that the
7 provisions of s. 373.139 relating to acquisition of real
8 property shall apply.
9 (2) The South Florida Water Management District's
10 participation as local sponsor is authorized for the
11 Comprehensive Review Study, or Restudy, of the Central and
12 Southern Florida Project for Flood Control and Other Purposes
13 for which federal participation was authorized and directed by
14 the Federal Water Resources Development Acts of 1992 and 1996
15 together with related Congressional resolutions. This
16 authorization includes the authority for the South Florida
17 Water Management District to provide any and all assistance
18 requested by the department, the Governor, or the Legislature
19 in their review of the Comprehensive Review Study. Upon
20 completion of the Restudy and prior to any action by the South
21 Florida Water Management District in furtherance of the
22 Restudy, the district is directed to provide the document to
23 the department, Governor, the Speaker of the House of
24 Representatives, and the President of the Senate. The South
25 Florida Water Management District is not authorized to
26 implement any proposed modification to the design or
27 operations of the Central and Southern Florida Project for
28 Flood Control and Other Purposes, expend any funds, or
29 otherwise implement a comprehensive plan, feasibility report,
30 or other proposed plan of action resulting from the Restudy,
31 including any action seeking further Congressional

1 authorizations or approvals, unless the plan or report is
2 approved by the Legislature with appropriate authorizations
3 for further district actions.
4 Section 2. This act shall take effect upon becoming a
5 law.
