1 A bill to be entitled
2 An act relating to postsecondary education;
3 establishing the Program in Medical Sciences as
4 a 2-year medical school within the Florida
5 State University; providing legislative
6 findings and intent; amending s. 458.3145,
7 F.S.; providing for the issuance of a medical
8 faculty certificate without examination to an
9 individual who has received a full-time faculty
10 appointment to teach a program of medicine at
11 Florida State University; requiring the Board
12 of Regents to commission an independent study;
13 providing components of the study; providing
14 for submission of the study to the Governor,
15 the President of the Senate, and the Speaker of
16 the House of Representatives by January 1,
17 1999; providing an effective date and a future
18 contingent effective date.

20 WHEREAS, the Legislature finds that more than 3.5
21 million Florida residents are over 60 years of age, and
22 WHEREAS, of those 3.5 million people, almost one
23 million are over 80 years of age, and
24 WHEREAS, while this segment of Florida's citizenry
25 represents almost one-fourth of Florida's total population, it
26 accounts for the majority of visits to physicians, and
27 WHEREAS, it is therefore the finding of the Legislature
28 that the health needs of this population are significant,
29 unique, and require specialized medical training, and
30 WHEREAS, it is the further finding of the Legislature
31 that the medical education of physicians serving this segment

1 of Florida's population should be focused on primary care with
2 a clinical orientation in geriatric medicine, and
3 WHEREAS, it is therefore the intent of the Legislature
4 to establish a medical school whose primary focus is
5 recruiting and training medical professionals to serve this
6 population and to serve as a resource for providing and
7 directing medical care for the elderly in this state, NOW,
8 THEREFORE,

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. The Program in Medical Sciences (PIMS) at
13 the Florida State University is established as a 2-year
14 medical program within the Florida State University. After
15 the initial 2-year academic education is provided at the
16 Florida State University, in Leon County, with rotation in
17 local community hospitals, the second 2-year clinical rotation
18 for Program In Medical Sciences (PIMS) students will include
19 experience in underserved areas and will be coordinated with
20 the University of Florida and the Mayo Clinic in Jacksonville,
21 Florida. The medical degree will be conferred by the
22 University of Florida. Students will be actively recruited
23 from underserved rural and urban areas of Florida, and all
24 training will emphasize the unique medical needs of Florida's
25 elder citizens.
26 Section 2. Paragraph (i) of subsection (1) and
27 subsection (4) of section 458.3145, Florida Statutes, is
28 amended to read:
29 458.3145 Medical faculty certificate.--
30 (1) A medical faculty certificate may be issued
31 without examination to an individual who:

1 (a) Is a graduate of an accredited medical school or
2 its equivalent, or is a graduate of a foreign medical school
3 listed with the World Health Organization;
4 (b) Holds a valid, current license to practice
5 medicine in another jurisdiction;
6 (c) Has completed the application form and remitted a
7 nonrefundable application fee not to exceed $500;
8 (d) Has completed an approved residency or fellowship
9 of at least 1 year or has received training which has been
10 determined by the board to be equivalent to the 1-year
11 residency requirement;
12 (e) Is at least 21 years of age;
13 (f) Is of good moral character;
14 (g) Has not committed any act in this or any other
15 jurisdiction which would constitute the basis for disciplining
16 a physician under s. 458.331;
17 (h) For any applicant who has graduated from medical
18 school after October 1, 1992, has completed, before entering
19 medical school, the equivalent of 2 academic years of
20 preprofessional, postsecondary education, as determined by
21 rule of the board, which must include, at a minimum, courses
22 in such fields as anatomy, biology, and chemistry; and
23 (i) Has been offered and has accepted a full-time
24 faculty appointment to teach in a program of medicine at:
25 1. The University of Florida,
26 2. The University of Miami,
27 3. The University of South Florida, or
28 4. Florida State University, or
29 5.4. The Mayo Clinic Jacksonville, Florida.
30 (2) The certificate authorizes the holder to practice
31 only in conjunction with his or her faculty position at an

1 accredited medical school and its affiliated clinical
2 facilities or teaching hospitals that are registered with the
3 Board of Medicine as sites at which holders of medical faculty
4 certificates will be practicing. Such certificate
5 automatically expires when the holder's relationship with the
6 medical school is terminated or after a period of 24 months,
7 whichever occurs sooner, and is renewable every 2 years by a
8 holder who applies to the board on a form prescribed by the
9 board and provides certification by the dean of the medical
10 school that the holder is a distinguished medical scholar and
11 an outstanding practicing physician.
12 (3) The holder of a medical faculty certificate issued
13 under this section has all rights and responsibilities
14 prescribed by law for the holder of a license issued under s.
15 458.311, except as specifically provided otherwise by law.
16 Such responsibilities include compliance with continuing
17 medical education requirements as set forth by rule of the
18 board. A hospital or ambulatory surgical center licensed under
19 chapter 395, health maintenance organization certified under
20 chapter 641, insurer as defined in s. 624.03,
21 multiple-employer welfare arrangement as defined in s.
22 624.437, or any other entity in this state, in considering and
23 acting upon an application for staff membership, clinical
24 privileges, or other credentials as a health care provider,
25 may not deny the application of an otherwise qualified
26 physician for such staff membership, clinical privileges, or
27 other credentials solely because the applicant is a holder of
28 a medical faculty certificate under this section.
29 (4) In any year, the maximum number of extended
30 medical faculty certificate holders as provided in subsection
31 (2) may not exceed 15 persons at each institution named in

1 subparagraphs (1)(i)1.-4.3. and at the facility named in s.
2 240.512 and may not exceed 5 persons at the institution named
3 in subparagraph (1)(i)5.4.
4 5. Annual review of all such certificate recipients
5 will be made by the deans of the accredited 4-year medical
6 schools within this state and reported to the Board of
7 Medicine.
8 (5) Notwithstanding subsection (1), any physician,
9 when providing medical care or treatment in connection with
10 the education of students, residents, or faculty at the
11 request of the dean of an accredited medical school within
12 this state or at the request of the medical director of a
13 statutory teaching hospital as defined in s. 408.07, may do so
14 upon registration with the board and demonstration of
15 financial responsibility pursuant to s. 458.320(1) or (2)
16 unless such physician is exempt under s. 458.320(5)(a). The
17 performance of such medical care or treatment must be limited
18 to a single period of time, which may not exceed 180
19 consecutive days, and must be rendered within a facility
20 registered under subsection (2) or within a statutory teaching
21 hospital as defined in s. 408.07. A registration fee not to
22 exceed $300, as set by the board, is required of each
23 physician registered under this subsection. However, no more
24 than three physicians per year per institution may be
25 registered under this subsection, and an exemption under this
26 subsection may not be granted to a physician more than once in
27 any given 5-year period.
28 Section 3. (1) The Board of Regents is directed to
29 commission an independent study of medical education in
30 Florida. In commissioning the study, the Board of Regents
31 shall solicit the involvement of affected universities in

1 Florida and clinical facilities, including the Mayo Clinic in
2 Jacksonville, with which the universities propose to affiliate
3 in order to provide clinical components of the curriculum. The
4 purpose of the study shall be to assess the current adequacy
5 and capacity of the state's undergraduate and graduate medical
6 education and training programs by determining whether older
7 Floridians have access to an adequate supply of geriatricians
8 and primary care physicians who understand the unique medical
9 needs of Florida's elders, and whether underrepresented
10 populations have fair and adequate access to medical education
11 and training in Florida. The study shall include:
12 (a) Recommended strategies to ensure access to medical
13 education by people from underserved rural and urban areas.
14 (b) Recommended strategies to increase the production
15 of primary care physicians who understand the unique medical
16 needs of Florida's elders.
17 (c) Issues that may be raised by the Liaison Committee
18 on Medical Education (LCME) and recommendations to resolve
19 such issues. The Liaison Committee on Medical Education shall
20 be invited to Florida in order to identify any areas of
21 concern in order to clarify and reach agreement regarding
22 actions necessary to address LCME concerns.
23 (d) A specific study of the fiscal and programmatic
24 implications of adding a second year to the Program in Medical
25 Sciences (PIMS) at Florida State University as provided for in
26 this act.
27 (e) Recommended strategies, an implementation plan,
28 and a timeline to achieve the objectives of the study and an
29 estimate of the fiscal and programmatic considerations
30 associated with each recommendation.

1 The study shall be considered by the Board of Regents in
2 developing its 5-year plan, and shall be submitted to the
3 Governor, the President of the Senate, and the Speaker of the
4 House of Representatives by January 1, 1999.
5 (2) This section shall take effect upon becoming a
6 law.
7 Section 4. Except as otherwise provided herein, this
8 act shall take effect July 1, 1999, unless repealed during the
9 1999 Regular Session of the Legislature. It is the intent of
10 the Legislature to repeal this act in the event that:
11 (1) The study commissioned by the Board of Regents
12 pursuant to this act finds that the expansion of the Program
13 in Medical Sciences at Florida State University under this act
14 would unquestionably jeopardize the accreditation of the
15 University of Florida School of Medicine; or
16 (2) The Legislature determines, based upon an
17 independent analysis of cost, that the cost of the expansion
18 of the Program in Medical Sciences at Florida State University
19 under this act is too prohibitive, and decides to cease
20 funding of the expansion.
