  1                      A bill to be entitled

  2         An act relating to workers' compensation;

  3         amending s. 440.092, F.S.; revising provisions

  4         relating to special requirements for

  5         compensability under Workers' Compensation Law

  6         to provide that certain injuries suffered by

  7         specified law enforcement and correctional

  8         officers shall be deemed to be injuries arising

  9         out of and in the course of employment;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

14         Section 1.  Subsection (2) of section 440.092, Florida

15  Statutes, is amended to read:

16         440.092  Special requirements for compensability;

17  deviation from employment; subsequent intervening accidents.--

18         (2)  GOING OR COMING.--An injury suffered while going

19  to or coming from work is not an injury arising out of and in

20  the course of employment whether or not the employer provided

21  transportation if such means of transportation was available

22  for the exclusive personal use by the employee, unless the

23  employee was engaged in a special errand or mission for the

24  employer. Notwithstanding any provision of law to the

25  contrary, an officer, as defined in s. 943.10(14), who is

26  going to or coming from work in an official law enforcement or

27  corrections vehicle shall be deemed to be engaged in a special

28  errand or mission for the respective employer.

29         Section 2.  This act shall take effect upon becoming a

30  law.

      With respect to special requirements for compensability
  4    under the Workers' Compensation Law, provides that an
      injury suffered by any employed or appointed full-time,
  5    part-time, or auxiliary law enforcement officer,
      correctional officer, or correctional probation officer
  6    who is going to or coming from work in an official law
      enforcement or corrections vehicle shall be deemed to be
  7    an injury arising out of and in the course of employment.
