  1                      A bill to be entitled

  2         An act relating to workers' compensation;

  3         amending s. 440.092, F.S.; revising provisions

  4         relating to special requirements for

  5         compensability under Workers' Compensation Law

  6         to provide that certain injuries suffered by

  7         law enforcement officers shall be deemed to be

  8         injuries arising out of and in the course of

  9         employment; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Subsection (2) of section 440.092, Florida

14  Statutes, is amended to read:

15         440.092  Special requirements for compensability;

16  deviation from employment; subsequent intervening accidents.--

17         (2)  GOING OR COMING.--An injury suffered while going

18  to or coming from work is not an injury arising out of and in

19  the course of employment whether or not the employer provided

20  transportation if such means of transportation was available

21  for the exclusive personal use by the employee, unless the

22  employee was engaged in a special errand or mission for the

23  employer. Notwithstanding any provision of law to the

24  contrary, a law enforcement officer, as defined in s.

25  943.10(1), who is going to or coming from work in an official

26  law enforcement vehicle shall be deemed to be engaged in a

27  special errand or mission for the employer.

28         Section 2.  This act shall take effect upon becoming a

29  law.
