1 A bill to be entitled
2 An act relating to implementing the 1998-1999
3 General Appropriations Act in the area of
4 criminal justice; providing legislative intent;
5 amending s. 216.181, F.S.; authorizing the
6 Department of Law Enforcement to transfer some
7 positions and a certain percentage of salary
8 rate between budget entities and providing
9 requirements with respect thereto; providing
10 for future repeal; providing for providing
11 effect of veto of specific appropriation or
12 proviso to which implementing language refers;
13 providing applicability to other legislation;
14 providing severability; providing an effective
15 date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. It is the intent of the Legislature that
20 the implementing and administering provisions of this act
21 apply to the fiscal year 1998-1999 General Appropriations Act
22 in the area of criminal justice.
23 Section 2. In order to implement Specific
24 Appropriation 1033 of the 1998-1999 General Appropriations
25 Act, subsection (16) is added to section 216.181, Florida
26 Statutes, to read:
27 216.181 Approved budgets for operations and fixed
28 capital outlay.--
29 (16) Notwithstanding any other provision of this
30 section to the contrary, and for the 1998-1999 fiscal year
31 only, the Florida Department of Law Enforcement may transfer

1 up to 20 positions between budget entities and up to 10
2 percent of the initial approved salary rate between budget
3 entities, provided the same funding source is used throughout
4 each transfer. The department must provide notice to the
5 Executive Office of the Governor, the chair of the Senate Ways
6 and Means Committee, and the chair of the House Committee on
7 Criminal Justice Appropriations for all transfers of positions
8 or salary rate. This subsection expires July 1, 1999.
9 Section 3. If any other act passed during the 1998
10 Regular Session of the Legislature or any extension thereof
11 contains a provision which is substantively the same as a
12 provision in this act, but which removes or is otherwise not
13 subject to the future repeal applied to such provision by this
14 act, the Legislature intends that the provision in the other
15 act shall take precedence and shall continue to operate,
16 notwithstanding the future repeal provided by this act.
17 Section 4. If any provision of this act or the
18 application thereof to any person or circumstance is held
19 invalid, the invalidity shall not affect other provisions or
20 applications of the act which can be given effect without the
21 invalid provision or application, and to this end the
22 provisions of this act are declared severable.
23 Section 5. This act shall take effect July 1, 1998;
24 or, in the event this act fails to become a law until after
25 that date, it shall operate retroactively thereto.
