17 Section 2. Subsection (1) of section 194.035, Florida
18 Statutes, is amended to read:
19 194.035 Special masters; property evaluators.--
20 (1) The board is authorized to appoint special
21 masters, with regard to questions of both valuation and law,
22 for the purpose of taking testimony and making recommendations
23 to the board, which recommendations the board may act upon
24 without further hearing. Such special masters may not be
25 elected or appointed officials or employees of the county but
26 shall be selected from a list of those qualified individuals
27 who are willing to serve as special masters. The clerk of the
28 board shall annually notify such individuals or their
29 professional associations to make known to them that
30 opportunities to serve as special masters exist. A special
31 master making recommendations on questions of law must shall

1 be either a member of The Florida Bar and knowledgeable in the
2 area of ad valorem taxation, and a special master making
3 recommendations on questions of valuation must be or a
4 designated member of a professionally recognized real estate
5 appraisers' organization and have not less than 5 years'
6 experience in property valuation. A special master need not
7 be a resident of the county in which he or she serves. No
8 special master shall be permitted to represent a person before
9 the board in any tax year during which he or she has served
10 that board as a special master. The board shall appoint such
11 masters from the list so compiled prior to convening of the
12 board. The expense of hearings before special masters and any
13 compensation of special masters shall be borne three-fifths by
14 the board of county commissioners and two-fifths by the school
15 board.
