18 Section 1. Subsection (4) of section 229.592, Florida
19 Statutes, is amended to read:
20 229.592 Implementation of state system of school
21 improvement and education accountability.--
22 (4) DEPARTMENT.--
23 (a) The Department of Education shall implement a
24 training program to develop among outstanding state and
25 district educators and administrators in all academic
26 disciplines and fields of administration a cadre of
27 facilitators of school improvement. These facilitators shall
28 assist schools and districts to conduct needs assessments and
29 develop and implement school improvement plans to meet state
30 goals and shall be organized into Florida Distinguished
31 Educator School Improvement Teams. Such teams may include

1 retired teachers and administrators, and such other persons
2 from areas of business or other vocations or professions, as
3 deemed appropriate by the department, based upon an appraisal
4 of the needs of the receiving school.
5 (b) Upon request, or as part of an assistance and
6 intervention plan approved by a district school board pursuant
7 to s. 230.23(16)(c), the department shall provide technical
8 assistance and training to any school, school advisory
9 council, district, or school board for conducting needs
10 assessments, developing and implementing school improvement
11 plans, developing and implementing assistance and intervention
12 plans, or implementing other components of school improvement
13 and accountability. Priority for these services shall be given
14 to school districts in rural and sparsely populated areas of
15 the state and to schools operating under an assistance and
16 intervention plan approved pursuant to s. 230.23(16)(c).
17 (c) Pursuant to s. 24.121(5)(d), the department shall
18 not release funds from the Educational Enhancement Trust Fund
19 to any district in which a school does not have an approved
20 school improvement plan, pursuant to s. 230.23(16), after 1
21 full school year of planning and development. At the expense
22 of the receiving school district, the department shall send a
23 Florida Distinguished Educator School Improvement technical
24 assistance Team to each school without an approved plan to
25 develop such school improvement plan. The department shall
26 release the funds upon approval of the school improvement
27 plan. Notice shall be given to the public of the department's
28 intervention and shall identify each school without an
29 approved school improvement a plan. If an assistance and
30 intervention plan has been approved pursuant to s.
31 230.23(16)(c), the department shall send, at the expense of

1 the receiving school district, a Florida Distinguished
2 Educator School Improvement Team to assist in the
3 implementation of the assistance and intervention plan, and
4 notice of the department's intervention shall be given to the
5 public.
6 Section 2. Paragraph (c) of subsection (16) of section
7 230.23, Florida Statutes, is amended to read:
8 230.23 Powers and duties of school board.--The school
9 board, acting as a board, shall exercise all powers and
10 perform all duties listed below:
11 (16) IMPLEMENT SCHOOL IMPROVEMENT AND
12 ACCOUNTABILITY.--Maintain a system of school improvement and
13 education accountability as provided by statute and State
14 Board of Education rule. This system of school improvement and
15 education accountability shall be consistent with, and
16 implemented through, the district's continuing system of
17 planning and budgeting required by this section and ss.
18 229.555 and 237.041. This system of school improvement and
19 education accountability shall include, but not be limited to,
20 the following:
21 (c) Assistance and intervention.--Develop a 3-year
22 plan of increasing individualized assistance and intervention
23 for each school that does not meet or make adequate progress,
24 based upon the recommendations of the commission, as defined
25 pursuant to statute and State Board of Education rule, toward
26 meeting the goals and standards of its approved school
27 improvement plan. Each assistance and intervention plan shall
28 include the use of a Florida Distinguished Educator School
29 Improvement Team as defined in s. 229.592(4)(a).
30 Section 3. Subsections (4) through (8) of section
31 232.246, Florida Statutes, are renumbered as subsections (5)

1 through (9), respectively, subsections (9) and (10) are
2 renumbered and amended, and a new subsection (4) is added to
3 said section, to read:
4 232.246 General requirements for high school
5 graduation.--
6 (4) High school juniors and seniors who are designated
7 by their principals as qualified to act as tutors for other
8 students in a specific academic area, and who engage in
9 tutoring under the supervision of qualified instructional
10 personnel and pursuant to a written agreement between
11 themselves, the school, and each student tutored, shall be
12 awarded one-half credit toward graduation for each semester
13 served. Each written agreement entered into under this
14 subsection shall specify the time, place, and manner of
15 tutoring. At the end of each semester, each tutor's
16 effectiveness shall be evaluated by his or her supervising
17 instructor. One-fourth additional credit per semester toward
18 graduation may be awarded to any student tutor who is deemed
19 worthy. Any student tutor whose performance is deemed
20 unsatisfactory may be precluded from participating in the
21 tutoring program until such time as, in the judgment of his or
22 her supervising instructor, any deficiencies have been
23 corrected. A supervising instructor need not preclude a
24 student's participation if, in his or her professional
25 judgment, any deficiencies can be corrected while the student
26 tutor continues his or her participation. Any measure of
27 effectiveness used to evaluate student tutors shall include,
28 but not be limited to, measurable academic progress or
29 improvement on behalf of the students tutored.
30 (10)(9) A student who meets all requirements
31 prescribed in subsections (1), (5) (4), and (6) (5) shall be

1 awarded a standard diploma in a form prescribed by the state
2 board. A school board may attach the Florida gold seal
3 vocational endorsement to a standard diploma or, instead of
4 the standard diploma, award differentiated diplomas to those
5 exceeding the prescribed minimums. A student who completes the
6 minimum number of credits and other requirements prescribed by
7 subsections (1) and (5) (4), but who is unable to meet the
8 standards of paragraph (6)(a) (5)(a), paragraph (6)(b) (5)(b),
9 or paragraph (6)(c) (5)(c), shall be awarded a certificate of
10 completion in a form prescribed by the state board. However,
11 any student who is otherwise entitled to a certificate of
12 completion may elect to remain in the secondary school either
13 as a full-time student or a part-time student for up to 1
14 additional year and receive special instruction designed to
15 remedy his or her identified deficiencies. This special
16 instruction shall be funded from the state compensatory
17 education funds of the district.
18 (11)(10) The public hearing and consideration required
19 in subsection (9) (8) shall not be construed to amend or
20 nullify the requirements of security relating to the contents
21 of examinations or assessment instruments and related
22 materials or data as prescribed in s. 232.248.
