1 A bill to be entitled
2 An act relating to Lee County; amending chapter
3 76-411, Laws of Florida, as amended; amending
4 the Enabling Act of the San Carlos Park Fire
5 Protection and Rescue Service District;
6 excluding certain lands within the district and
7 revising powers of the board of the district;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. The San Carlos Park Fire Protection and
13 Rescue Service District in Lee County, as created by
14 subsection (2) of section 2 of chapter 76-411, Laws of
15 Florida, as amended, is amended to exclude the land described
16 as follows:
17 That certain tract of land in the Southwest
18 Quarter (SW 1/4) of Section 23, Township 46
19 South, Range 25 East, Lee County, Florida,
20 lying West of I-75 Right-of-Way line. Said
21 lands containing 62.35 acres, more or less.
22 Section 2. The board of the San Carlos Park Fire
23 Protection and Rescue Service District, as created by
24 subsection (2) of section 2 of chapter 76-411, Laws of
25 Florida, as amended, shall have the right, power and authority
26 to levy millage tax against the taxable real estate within the
27 district to provide funds for the purpose of this district.
28 The tax rate shall be fixed by a resolution of the board
29 following public hearings of the proposed budget as provided
30 by general law. However, the tax shall not exceed $3.75 per
31 $1,000.00 of net taxable assessed valuation. It is the

1 legislative intent that this act will authorize the Lee County
2 Property Appraiser and the Lee County Tax Collector to take
3 all appropriate action to comply with the intent and purpose
4 of this act.
5 Section 3. The provisions of section 2 which authorize
6 the levy of ad valorem taxation shall take effect only upon
7 the express approval by a majority vote of those qualified
8 electors of the district, as required by section 9 of article
9 VII of the State Constitution, voting in a referendum election
10 to be held in accordance with the provisions of law currently
11 in force in Lee County, except that this subsection shall take
12 effect upon becoming a law. The district shall bear the costs
13 of the referendum required by this act.
14 Section 4. This act shall take effect upon becoming a
15 law.
