ENROLLED 1997 Legislature HB 427, First Engrossed 1 2 An act relating to Lee County; amending chapter 3 76-411, Laws of Florida, as amended; amending 4 the Enabling Act of the San Carlos Park Fire 5 Protection and Rescue Service District; 6 excluding certain lands within the district and 7 revising powers of the board of the district; 8 providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. The San Carlos Park Fire Protection and 13 Rescue Service District in Lee County, as created by 14 subsection (2) of section 2 of chapter 76-411, Laws of 15 Florida, as amended, is amended to exclude the land described 16 as follows: 17 That certain tract of land in the Southwest 18 Quarter (SW 1/4) of Section 23, Township 46 19 South, Range 25 East, Lee County, Florida, 20 lying West of I-75 Right-of-Way line. Said 21 lands containing 62.35 acres, more or less. 22 Section 2. Subsection (2) of Section 5 of chapter 23 76-411, Laws of Florida, as amended by chapter 80-521, Laws of 24 Florida, is amended to read: 25 (2) The tax rate shall be fixed by a resolution of the 26 board following public hearings of the proposed budget as 27 provided in section 6. However, the tax shall not exceed $2 28 $3.75 per $1,000 of net taxable assessed valuation. 29 Section 3. The provisions of section 2 which authorize 30 the levy of ad valorem taxation shall take effect only upon 31 the express approval by a majority vote of those qualified 1 CODING: Words stricken are deletions; words underlined are additions. ENROLLED 1997 Legislature HB 427, First Engrossed 1 electors of the district, as required by section 9 of article 2 VII of the State Constitution, voting in a referendum election 3 to be held in accordance with the provisions of law currently 4 in force in Lee County, except that this subsection shall take 5 effect upon becoming a law. The district shall bear the costs 6 of the referendum required by this act. 7 Section 4.
