  1                      A bill to be entitled

  2         An act relating to administrative fines;

  3         providing for deposit of fines collected by

  4         executive-branch agencies to be deposited into

  5         the General Revenue Fund; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Notwithstanding any other provision of law,

11  the proceeds from any fine levied and collected by an agency

12  in the executive branch of state government shall be deposited

13  into the General Revenue Fund.

14         Section 2.  Any fine, penalty, or settlement agreement

15  costs collected by an agency in the executive branch must be

16  implemented from specific statutory authority, and if

17  described or referenced in rule, such rule must be adopted

18  pursuant to the Administrative Procedure Act.  It will not be

19  acceptable to impose a fine, penalty, or settlement agreement

20  costs based upon program guidance or agency policy.

21         Section 3.  This act shall take effect July 1, 2000.
