17 Section 1. (1) There is created the Florida
18 Retirement Benefit Study Commission for the purpose of
19 advising the Legislature and the Governor on measures in the
20 formulation and implementation of an innovative, efficient
21 retirement program.
22 (a) The commission shall consist of 19 members, as
23 follows:
24 1. Two members appointed by the President of the
25 Senate, one representing the majority party and one
26 representing the minority party;
27 2. Two members appointed by the Speaker of the House
28 of Representatives, one representing the majority party and
29 one representing the minority party;
30 3. The Governor shall appoint the following commission
31 members based upon the recommendations of each of the

1 respective employer or employee member organizations:
2 a. Two members representing the financial services
3 industry;
4 b. One member representing the Division of Retirement;
5 c. One member representing the Department of
6 Management Services;
7 d. One member representing the State Board of
8 Administration;
9 e. Two members representing municipality members of
10 the Florida Retirement System, one representing the employer,
11 and one representing nonmanagerial, nonsupervisory employees;
12 f. Two members representing counties, one representing
13 the employer and one representing nonmanagerial,
14 nonsupervisory employees;
15 g. Two members representing special district members
16 of the Florida Retirement System, one representing the
17 employer, and one representing nonmanagerial, nonsupervisory
18 employees;
19 h. Two representatives of school boards, one
20 representing the employer and one representing nonmanagerial,
21 nonsupervisory employees; and
22 i. Two representatives of state employees, one
23 representing managerial/supervisory employees, and one
24 representing nonmanagerial/nonsupervisory employees.
25 (2) It is the duty of the commission to:
26 (a) Review existing defined benefit and defined
27 contribution pension plans, taking into consideration:
28 1. The proper relationship of employer and employee
29 contributions to any alternate plan;
30 2. Any effects on the existing retirement plan
31 resulting from implementation of a new retirement plan,

1 including, but not limited to:
2 a. Demographic factors;
3 b. Geographic factors;
4 c. Vesting rights and portability options;
5 d. Other factors influencing the demand for either
6 program; and
7 e. The allocation of unfunded actuarial liabilities.
8 (b) Recommend and address:
9 1. To what extent employers are responsible for
10 educating employees regarding the differences in the two
11 plans, and regarding their investment choices;
12 2. Program administration and its cost; and
13 3. The offering of plans independently, or as a group.
14 (3) The commission shall make its recommendation in an
15 official report, adopted by the commission and transmitted to
16 the Governor, the President of the Senate, and the Speaker of
17 the House of Representatives by January 1, 1999.
18 (4) Commission members shall be appointed by August 1,
19 1998, and shall convene to organize immediately after the
20 appointments have been completed.
21 (5) Members of the commission shall serve without
22 compensation. Members of the commission shall be entitled to
23 receive reimbursement for travel and per diem as provided in
24 section 112.061, Florida Statutes, while carrying out official
25 business of the commission.
26 (6) The commission shall hold meetings within the
27 state when deemed necessary.
28 Section 2. The Division of Retirement shall furnish
29 staff services to the commission.
30 Section 3. This act shall take effect upon becoming a
31 law.

6 A bill to be entitled
7 An act relating to retirement; creating the
8 Florida Retirement Benefit Study Commission;
9 providing for membership; providing powers and
10 duties of the commission; requiring reports;
11 providing for staffing of the commission;
12 providing an effective date.

14 WHEREAS, pursuant to chapter 97-296, Laws of Florida,
15 the Workforce 2000 Study Commission completed a comprehensive
16 study comparing employee benefits in the public and private
17 sectors, and
18 WHEREAS, the appropriate application of a
19 business-sector plan in the public sector might enable a more
20 efficient use of public tax dollars while providing additional
21 choices for the workforce, and
22 WHEREAS, the initiative to create an efficient,
23 innovative workforce in the public sector can be accomplished
24 through a review of all of the components of public-employee
25 compensation, and
26 WHEREAS, the proper relationship of salary and benefit
27 compensation is a critical issue in personnel administration
28 policies in the public sector, NOW, THEREFORE,
