18 Section 1. Subsection (17) is added to section 230.23,
19 Florida Statutes, to read:
20 230.23 Powers and duties of school board.--The school
21 board, acting as a board, shall exercise all powers and
22 perform all duties listed below:
23 (17) ADOPT RULES.--Adopt rules pursuant to ss. 120.54
24 and 120.536(1) to implement the provisions of this section.
25 Section 2. Section 230.23005, Florida Statutes, is
26 created to read:
27 230.23005 Supplemental powers and duties of school
28 board.--The school board may exercise the following
29 supplemental powers and duties. Any provision of chapters 228,
30 229, 230, 231, 232, 233, 234, and 235 prevails over any
31 conflicting provision of this section. The rules adopted under

1 this section must not be inconsistent with the provisions of
2 chapters 228, 229, 230, 231, 232, 233, 234, and 235.
3 (1) STUDENT MANAGEMENT.--The school board may adopt
4 programs and policies to ensure the safety and welfare of
5 individuals, the student body, and school personnel, which
6 programs and policies may:
7 (a) Prohibit the possession of weapons and drugs on
8 campus, student hazing, and other activities that could
9 threaten the operation of the school or the safety and welfare
10 of the student body or school personnel.
11 (b) Require uniforms to be worn by the student body,
12 or impose other dress related requirements, if the board finds
13 that those requirements are necessary for the safety or
14 welfare of the student body or school personnel.
15 (c) Provide procedures for student dismissal
16 precautions and for granting permission for students to leave
17 school grounds during school hours, including releasing a
18 student from school upon request by a parent or guardian or
19 for public appearance of school groups.
20 (d) Provide procedures for managing protests,
21 demonstrations, sit-ins, walk-outs, or other acts of civil
22 disobedience.
23 (e) Provide procedures for detaining students and for
24 readmission of students after expulsion.
25 (f) Regulate student automobile use and parking.
26 (2) FISCAL MANAGEMENT.--The school board may adopt
27 policies providing for fiscal management of the school
28 district with respect to school purchasing, facilities,
29 nonstate revenue sources, budgeting, fundraising, and other
30 activities relating to the fiscal management of district
31 resources, including, but not limited to, the policies

1 governing:
2 (a) Sales calls and demonstrations by agents,
3 solicitors, salesmen, and vendors on campus; local preference
4 criteria for vendors; specifications for quantity purchasing;
5 prioritization of awards for bids; declining bid awards; and
6 purchase requisitions, approvals, and routing.
7 (b) Sales by booster clubs; marathon fundraisers; and
8 student sales of candy, paper products, or other goods
9 authorized by the board.
10 (c) Inventory and disposal of district property; use
11 of safe deposit boxes; and selection of real estate
12 appraisers.
13 (d) Payment of contractors and other service
14 providers.
15 (e) Accounting systems; petty cash accounts procedures
16 and reporting; school activities funds procedures and
17 reporting; management and reporting of grants from private
18 sources; and management of funds, including auxiliary
19 enterprise funds.
20 (f) District budgeting system, including setting
21 budget deadlines and schedules, budget planning, and
22 implementation and determination of budget priorities.
23 (3) INSTRUCTIONAL AIDS.--The school board may adopt
24 policies providing for innovative teaching techniques,
25 teaching programs and methods, instructional aids and
26 objectives, extracurricular and interscholastic activities,
27 and supplemental programs including, but not limited to
28 policies providing for:
29 (a) Use of technology, including appropriate use of
30 the Internet as a tool for learning.
31 (b) Instructional priorities and objectives, pilot

1 projects and evaluations, curriculum adoption and design, and
2 lesson planning.
3 (c) Extracurricular and interscholastic activities,
4 including field trips, publishing a student newspaper and
5 other publications, and special programs relating to the arts,
6 music, or other topics of current interest.
7 (d) Participation in physical education programs,
8 including appropriate physical education attire and protective
9 gear; exceptional student programs for handicapped, disabled
10 and exceptional students; summer school; and the Title I
11 program, including comparability procedures.
12 (4) FACILITIES MANAGEMENT.--The school board may adopt
13 policies providing for management of the physical campus and
14 its environs, including, but not limited to energy
15 conservation measures; building and ground maintenance;
16 fencing, landscaping and other property improvements; site
17 acquisition; new construction and renovation; dedication and
18 rededication or naming and renaming of district buildings and
19 other district facilities; and development of facilities
20 management planning and priorities.
21 (5) SCHOOL COMMUNITY RELATIONS.--The school board may
22 adopt policies governing public gifts and donations to
23 schools; input from the community concerning instruction
24 resources; advertising in schools; participation in community
25 affairs, including coordination with local governments,
26 planning authorities, community colleges, universities, and
27 community coalitions; protocols for interagency agreements;
28 business community partnerships; community use of school
29 facilities; public solicitations in schools, including the
30 distribution and posting of promotional materials and
31 literature; visitors to the school campus; school advisory

1 councils; and parent volunteers and chaperones.
2 (6) LEGAL ISSUES.--The school board may adopt policies
3 and procedures necessary to implement federal mandates and
4 programs, court orders, and other legal requirements of the
5 state.
6 (7) FIRST AID AND EMERGENCIES.--The school board may
7 adopt programs and policies to ensure appropriate response in
8 emergency situations; the provision of first aid to
9 individuals, the student body, and school personnel; and the
10 effective management of student illness, which programs and
11 policies may include, but are not limited to:
12 (a) The provision of first aid and emergency medical
13 care and the provision of school health care facilities and
14 services.
15 (b) The provision of school safety patrol.
16 (c) Procedures for reporting hazards, including
17 threats of nature, bomb threats, threatening messages, and
18 similar occurrences, and the provision of warning systems
19 including alarm systems and other technical devices.
20 (d) Procedures for evacuating the classrooms,
21 playground, or any other district facility.
22 (e) Procedures for reporting accidents, including
23 traffic accidents and traffic violations involving
24 district-owned vehicles.
25 (f) Student insurance programs.
26 (8) STUDENT ASSESSMENT AND AFFAIRS.--The school board
27 may adopt policies and procedures governing attendance
28 monitoring and checks; truancy; graduation requirements and
29 graduation exercises; fees, fines, and charges imposed on
30 students; evaluation of student records and transcripts;
31 transfer of student records; grading and academic evaluation

1 of students; tests and examinations, including early
2 examinations; guidance and counseling; and student
3 participation in competitions, student performances and
4 exhibitions, contests for students, and social events.
5 (9) ADMINISTRATIVE SUPPORT SERVICES.--The school board
6 may adopt policies and procedures governing purchase of
7 property insurance, including comprehensive general liability
8 insurance; transportation of students for extracurricular
9 activities and special events, including transportation of
10 students in privately owned vehicles; transportation of
11 district personnel, including personal use of district owned
12 vehicles; computer security and computer room access and
13 computer data base resources; mail and delivery services,
14 including use of couriers; copyright compliance; computerized
15 data systems, including computer use, transmission of data,
16 access to the Internet, and other technology-based services.
17 (10) SCHOOL BOARD GOVERNANCE AND OPERATIONS.--The
18 school board may adopt policies and procedures necessary for
19 the daily business operation of the school board, including,
20 but not limited to, the provision of legal services for the
21 school board; conducting a district legislative program;
22 school board member participation at conferences, conventions,
23 and workshops, including member compensation and reimbursement
24 for expenses; school board policy development, adoption, and
25 repeal; school board meeting procedures, including
26 participation via telecommunications networks, use of
27 technology at meetings, and presentations by nondistrict
28 personnel; citizen communications with the school board and
29 with individual school board members; collaboration with local
30 government and other entities as required by law; and
31 organization of the board, including special committees and

1 advisory committees.
2 (11) PERSONNEL.--The school board may adopt policies
3 and procedures necessary for the management of all personnel
4 of the school system.
5 Section 3. This act shall take effect upon becoming a
6 law.
