11  Senator Dyer moved the following amendment:

13         Senate Amendment 

14         On page 2, lines 11 through 21, delete those lines

15

16  and insert:

17         (2)  Equipment, machinery, or materials required to

18  meet any law implemented by, or any condition of a permit

19  issued by, the Department of Environmental Protection which

20  are purchased for the monitoring, prevention, abatement, or

21  control of pollution or contaminants at privately owned or

22  operated landfills or construction and demolition debris

23  disposal facilities shall be exempt from taxation as otherwise

24  imposed by this chapter; however, such exemption shall not be

25  allowed unless the purchaser signs a certificate stating that

26  the equipment, machinery, or materials to be exempted are

27  required to meet such law or condition. This exemption does

28  not include solid waste collection vehicles, compactors,

29  graders, or other earthmoving equipment.
