Florida House of Representatives - 1997 CS/HJR 437 By the Committee on Election Reform and Representative Miller 1 House Joint Resolution 2 A joint resolution proposing the creation of 3 Section 10 of Article II of the State 4 Constitution, relating to elected public 5 officers. 6 7 Be It Resolved by the Legislature of the State of Florida: 8 9 That the creation of Section 10 of Article II of the 10 State Constitution set forth below is agreed to and shall be 11 submitted to the electors of Florida for approval or rejection 12 at the general election to be held in November 1998: 13 ARTICLE II 14 GENERAL PROVISIONS 15 SECTION 10. Elected public officers; relinquishment of 16 office upon failure to maintain same political party 17 registration.--An elected public officer relinquishes office 18 upon the officer's failure to maintain registration as a 19 member of the same political party in which the officer was 20 registered when qualified for and elected to that office, 21 except that an officer may change his or her party affiliation 22 without creating a vacancy if the officer is changing party 23 affiliation within 60 days of qualifying for election to the 24 same or a different office. A vacancy will not occur if the 25 office to which the officer was elected is an office that must 26 be filled by nonpartisan election. 27 BE IT FURTHER RESOLVED that in accordance with the 28 requirements of section 101.161, Florida Statutes, the title 29 and substance of the amendment proposed herein shall appear on 30 the ballot as follows: 31 ELECTED PUBLIC OFFICERS; RELINQUISHMENT 1 CODING: Words stricken are deletions; words underlined are additions.
