2 A joint resolution proposing the creation of
3 Section 10 of Article II of the State
4 Constitution, relating to elected public
5 officers.

7 Be It Resolved by the Legislature of the State of Florida:

9 That the creation of Section 10 of Article II of the
10 State Constitution set forth below is agreed to and shall be
11 submitted to the electors of Florida for approval or rejection
12 at the general election to be held in November 1998:
13 ARTICLE II
14 GENERAL PROVISIONS
15 SECTION 10. Elected public officers; relinquishment of
16 office upon failure to maintain same political party
17 registration.--An elected public officer relinquishes office
18 upon the officer's failure to maintain registration as a
19 member of the same political party in which the officer was
20 registered when qualified for and elected to that office.
21 However, an officer may change his or her party affiliation
22 without creating a vacancy if the officer qualifies for
23 reelection to the same office or election to a different
24 office within 60 days after changing party affiliation. A
25 vacancy will not occur if the office to which the officer was
26 elected is an office that must be filled by nonpartisan
27 election.
28 BE IT FURTHER RESOLVED that in accordance with the
29 requirements of section 101.161, Florida Statutes, the title
30 and substance of the amendment proposed herein shall appear on
31 the ballot as follows:

3 SAME POLITICAL PARTY REGISTRATION
4 Providing that an elected public officer relinquishes
5 office upon failing to maintain registration in the same
6 political party in which the officer was registered when the
7 officer qualified for and was elected to that office, unless
8 the office is nonpartisan, except that the officer may change
9 party affiliation without creating a vacancy if the officer
10 qualifies for reelection to the same office or election to a
11 different office within 60 days after changing party
12 affiliation.
