  1                      A bill to be entitled

  2         An act relating to volunteers; amending s.

  3         112.3135, F.S.; providing an exemption from the

  4         nepotism law for persons providing volunteer

  5         emergency medical, firefighting, and police

  6         services; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Paragraph (a) of subsection (2) of section

11  112.3135, Florida Statutes, is amended to read:

12         112.3135  Restriction on employment of relatives.--

13         (2)(a)  A public official may not appoint, employ,

14  promote, or advance, or advocate for appointment, employment,

15  promotion, or advancement, in or to a position in the agency

16  in which the official is serving or over which the official

17  exercises jurisdiction or control any individual who is a

18  relative of the public official. An individual may not be

19  appointed, employed, promoted, or advanced in or to a position

20  in an agency if such appointment, employment, promotion, or

21  advancement has been advocated by a public official, serving

22  in or exercising jurisdiction or control over the agency, who

23  is a relative of the individual or if such appointment,

24  employment, promotion, or advancement is made by a collegial

25  body of which a relative of the individual is a member.

26  However, this subsection shall not apply to appointments to

27  boards other than those with land-planning or zoning

28  responsibilities in those municipalities with less than 35,000

29  population.  This subsection does not apply to persons serving

30  in a volunteer capacity who provide emergency medical,

31  firefighting, or police services. Such persons may receive,

  1  without losing their volunteer status, reimbursements for the

  2  costs of any training they get relating to the provision of

  3  volunteer emergency medical, firefighting, or police services

  4  and payment for any incidental expenses relating to those

  5  services that they provide.

  6         Section 2.  This act shall take effect upon becoming a

  7  law.
