14         Amendment 

15         On page 38, between lines 20 and 21 of the bill

16

17  insert:

18         Section 17.  Subsection (15) of section 376.301 is

19  amended to read:

20         376.301  Definitions of terms used in ss.

21  376.30-376.319, 376.70, and 376.75.--When used in ss.

22  376.30-376.319, 376.70, and 376.75, unless the context clearly

23  requires otherwise, the term:

24         (15)  "Facility" means a nonresidential location

25  containing, or which contained, any underground stationary

26  tank or tanks which contain hazardous substances or pollutants

27  and have individual storage capacities greater than 110

28  gallons, or any aboveground stationary tank or tanks which

29  contain pollutants which are liquids at standard ambient

30  temperature and pressure and have individual storage

31  capacities greater than 550 gallons.  A facility includes a

 1  petroleum storage system at any location that is used

 2  primarily for the generation of emergency electric power

 3  during disruption of normal utility services. This subsection

 4  shall not apply to facilities covered by chapter 377, or

 5  containers storing solid or gaseous pollutants, and

 6  agricultural tanks having storage capacities of less than 550

 7  gallons.
