17 Section 51. Section 501.937, Florida Statutes, is
18 created to read:
19 501.937 Industrial hygienists and safety
20 professionals; use of professional titles; failure to
21 comply.--
22 (1) Any person representing himself or herself as a
23 "safety professional" or "industrial hygienist" must
24 accurately disclose his or her credentials.
25 (2) A person may not represent himself or herself as a
26 "certified safety professional," "associate safety
27 professional," "certified occupational health and safety
28 technologist," "industrial hygienist in training," or
29 "certified industrial hygienist" unless he or she holds a
30 current valid certificate in the field of safety or industrial
31 hygiene from either the American Board of Industrial Hygiene

1 or the Board of Certified Safety Professionals, or unless the
2 Department of Business and Professional Regulation has, upon
3 request, examined another certification program and has
4 formally concluded that the certification standards of that
5 certification program are substantially equivalent to the
6 standards for certificates issued by those organizations; nor
7 may the person mislead or deceive anyone by the unauthorized
8 use of any certification mark that has been awarded by the
9 United States Patent and Trademark Office.
10 (3)(a) A "safety professional" is a person having a
11 baccalaureate degree in safety, engineering, chemistry,
12 physics, or a closely related physical or biological science
13 who has acquired competency in the field of safety. The
14 studies and training necessary to acquire such competency
15 should have been sufficient in all of the above cognate
16 sciences to provide the abilities to anticipate, identify, and
17 evaluate hazardous conditions and practices; to develop hazard
18 control designs, methods, procedures, and programs; to
19 implement, administer, and advise others on hazard controls
20 and hazard control programs; and to measure, audit, and
21 evaluate the effectiveness of hazard controls and hazard
22 control programs.
23 (b) An "industrial hygienist" is a person having a
24 baccalaureate degree in engineering, chemistry, physics, or a
25 closely related physical or biological science who has
26 acquired competency in the field of industrial hygiene. The
27 studies and training necessary to acquire such competency
28 should have been sufficient in all of the above cognate
29 sciences to provide the abilities to anticipate and recognize
30 the environmental factors and stresses associated with work
31 and work operations and to understand their effects on people

1 and their well-being; to evaluate, on the basis of training
2 and experience and with the aid of quantitative measurement
3 techniques, the magnitude of these factors and stresses in
4 terms of ability to impair human health and well-being; and to
5 prescribe methods to eliminate, control, or reduce such
6 factors and stresses when necessary to alleviate their
7 effects.
8 (4) Failure to comply with this section constitutes a
9 deceptive and unfair trade practice.
