1 A bill to be entitled
2 An act relating to the Florida Safety Belt Law;
3 amending s. 316.614, F.S.; providing that it is
4 unlawful to operate a motor vehicle in this
5 state unless each passenger of the vehicle
6 under the age of 16 is restrained by a safety
7 belt or child restraint device; providing an
8 exception to safety belt use; eliminating a
9 provision which requires enforcement of the act
10 only as a secondary action; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsections (4) and (8) of section 316.614,
16 Florida Statutes, 1996 Supplement, are amended, and paragraph
17 (c) is added to subsection (6) of said section, to read:
18 316.614 Safety belt usage.--
19 (4) It is unlawful for any person:
20 (a) To operate a motor vehicle in this state unless
21 each front seat passenger of the vehicle under the age of 16
22 years is restrained by a safety belt or by a child restraint
23 device pursuant to s. 316.613, if applicable; or
24 (b) To operate a motor vehicle in this state unless
25 the person is restrained by a safety belt.

27 (c) An employee of a solid waste or recyclable
28 collection service is not required to be restrained by a
29 safety belt while in the course of employment collecting solid
30 waste or recyclables on designated routes.

1 (8) Any person who violates the provisions of this
2 section commits a nonmoving violation, punishable as provided
3 in chapter 318. However, enforcement of this section by state
4 or local law enforcement agencies must be accomplished only as
5 a secondary action when a driver of a motor vehicle has been
6 detained for a suspected violation of another section of this
7 chapter, chapter 320, or chapter 322.
8 Section 2. This act shall take effect October 1, 1997.
