  1                      A bill to be entitled

  2         An act relating to candidates for public

  3         office; amending s. 99.012, F.S.; requiring a

  4         subordinate officer, deputy sheriff, or police

  5         officer seeking to qualify for a public office

  6         to resign or take a leave of absence, depending

  7         on certain circumstances relating to the office

  8         sought; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (5) of section 99.012, Florida

13  Statutes, is amended to read:

14         99.012  Restrictions on individuals qualifying for

15  public office.--

16         (5)(a)  A person who is a subordinate officer, deputy

17  sheriff, or police officer must need not resign effective upon

18  qualifying if pursuant to this section unless the person is

19  seeking to qualify for a public office which is currently held

20  by an officer who has authority to appoint, employ, promote,

21  or otherwise supervise that person and who has qualified as a

22  candidate for reelection to that office.

23         (b)  However, Upon qualifying, a the subordinate

24  officer, deputy sheriff, or police officer who is seeking to

25  qualify for a public office which is not held by an officer

26  who has authority to appoint, employ, promote, or otherwise

27  supervise that person must take a leave of absence without pay

28  during the period in which he or she is a candidate for

29  office.

30         Section 2.  This act shall take effect July 1 of the

31  year in which enacted.
