4 Fund within the Department of Children and
5 Family Services; providing for sources of
6 moneys and purposes; providing for future
7 review and termination or re-creation of the
8 trust fund; providing a contingent effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. The Affordable Residential Accommodations
14 Trust Fund is hereby created, to be administered by the
15 Department of Children and Family Services. Funds shall be
16 credited to the trust fund as provided in HB 3567 or similar
17 legislation, to be used for the purposes set forth therein.
18 Section 2. (1) Pursuant to the provisions of s.
19 19(f)(2), Art. III of the State Constitution, the Affordable
20 Residential Accommodations Trust Fund shall, unless terminated
21 sooner, be terminated on July 1, 2001.
22 (2) Prior to the regular legislative session
23 immediately preceding the date on which the trust fund is
24 scheduled to be terminated, the Department of Children and
25 Family Services and the Governor shall recommend to the
26 President of the Senate and the Speaker of the House of
27 Representatives whether the trust fund should be allowed to
28 terminate or should be re-created. These recommendations
29 shall be based on a review of the purpose and use of the trust
30 fund and a determination of whether the trust fund will
31 continue to be necessary. A recommendation to re-create the

1 trust fund may include suggested modifications to the
2 purposes, sources of receipts, and allowable expenditures for
3 the trust fund. The department's recommendation shall be made
4 as a part of its legislative budget request to the Legislature
5 pursuant to s. 216.023, Florida Statutes. The Governor's
6 recommendation shall be made as a part of the recommended
7 budget presented to the Legislature pursuant to s. 216.162,
8 Florida Statutes.
9 (3) If the trust fund is terminated, the Department of
10 Children and Family Services shall pay any outstanding debts
11 or obligations of the trust fund as soon as practicable and
12 the Comptroller shall close out and remove the trust fund from
13 the various state accounting systems, using generally accepted
14 accounting practices concerning warrants outstanding, assets,
15 and liabilities.
16 Section 3. This act shall take effect July 1 of the
17 year in which enacted, if HB 3567 or similar legislation is
18 adopted in the same legislative session or an extension
19 thereof.
