  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Inmate Welfare Trust Fund within the Department

  4         of Corrections; providing for purposes and

  5         sources of funds; providing for annual

  6         carryforward of funds; providing for future

  7         review and termination or re-creation of the

  8         trust fund; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  (1)  There is hereby created in the

13  Department of Corrections the Inmate Welfare Trust Fund. The

14  purpose of the trust fund shall be the benefit and welfare of

15  inmates incarcerated in correctional facilities operated by

16  the department. Moneys shall be deposited in the trust fund

17  and expenditures made from the trust fund as provided in s.

18  945.215, Florida Statutes.

19         (2)  Notwithstanding the provisions of s. 216.301 and

20  pursuant to s. 216.351, Florida Statutes, any balance in the

21  trust fund at the end of any fiscal year shall remain in the

22  trust fund at the end of the year and shall be available for

23  carrying out the purposes of the trust fund.

24         (3)  Pursuant to the provisions of s. 19(f)(2), Art.

25  III of the State Constitution, the trust fund shall, unless

26  terminated sooner, be terminated on July 1, 2002. However,

27  prior to its scheduled termination, the trust fund shall be

28  reviewed as provided in s. 215.3206(1) and (2), Florida

29  Statutes.

30         Section 2.  This act shall take effect July 1 of the

31  year in which enacted.
