  2         An act relating to trust funds; creating the

  3         Privately Operated Institutions Inmate Welfare

  4         Trust Fund within the Department of

  5         Corrections; providing for purposes and sources

  6         of funds; providing for annual carryforward of

  7         funds; providing for future review and

  8         termination or re-creation of the trust fund;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  (1)  There is hereby created in the

14  Department of Corrections the Privately Operated Institutions

15  Inmate Welfare Trust Fund. The purpose of the trust fund shall

16  be the benefit and welfare of inmates incarcerated in private

17  correctional facilities under contract with the department

18  pursuant to chapter 944, Florida Statutes, or the Correctional

19  Privatization Commission pursuant to chapter 957, Florida

20  Statutes. Moneys shall be deposited in the trust fund and

21  expenditures made from the trust fund as provided in s.

22  945.215, Florida Statutes.

23         (2)  Notwithstanding the provisions of s. 216.301 and

24  pursuant to s. 216.351, Florida Statutes, any balance in the

25  trust fund at the end of any fiscal year shall remain in the

26  trust fund at the end of the year and shall be available for

27  carrying out the purposes of the trust fund.

28         (3)  Pursuant to the provisions of s. 19(f)(2), Art.

29  III of the State Constitution, the trust fund shall, unless

30  terminated sooner, be terminated on July 1, 2002. However,

31  prior to its scheduled termination, the trust fund shall be

  1  reviewed as provided in s. 215.3206(1) and (2), Florida

  2  Statutes.

  3         Section 2.  This act shall take effect July 1 of the

  4  year in which enacted.
