  1                      A bill to be entitled

  2         An act relating to agriculture; creating s.

  3         570.191, F.S.; creating the Agricultural

  4         Emergency Eradication Trust Fund; providing for

  5         sources of moneys and purposes; providing for

  6         annual carryforward of funds; providing for

  7         future review and termination or re-creation of

  8         the trust fund; providing a contingent

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Section 570.191, Florida Statutes, is

14  created to read:

15         570.191  Agricultural Emergency Eradication Trust

16  Fund.--

17         (1)  The Agricultural Emergency Eradication Trust Fund

18  is created within the Department of Agriculture and Consumer

19  Services.

20         (2)  Funds to be deposited into the trust fund shall

21  consist of such funds transferred by the Comptroller from the

22  Working Capital Fund as are approved by the Administration

23  Commission pursuant to s. 215.32.

24         (3)  Funds in the trust fund shall be made available to

25  the department when the Commissioner of Agriculture declares

26  an agricultural emergency and when funds were not specifically

27  appropriated to respond to the agricultural emergency or funds

28  specifically appropriated to respond to the agricultural

29  emergency are insufficient to eliminate the agricultural

30  emergency.

  1         (4)  Notwithstanding the provisions of s. 216.301 and

  2  pursuant to s. 216.351, any balance in the trust fund at the

  3  end of any fiscal year shall remain in the trust fund at the

  4  end of that year and shall be available for carrying out the

  5  purposes of the trust fund.

  6         (5)  Pursuant to the provisions of s. 19(f)(2), Art.

  7  III of the State Constitution, the trust fund shall, unless

  8  terminated sooner, be terminated on July 1, 2002. Prior to its

  9  scheduled termination, the trust fund shall be reviewed as

10  provided in s. 215.3206(1) and (2).

11         Section 2.  This act shall take effect July 1 of the

12  year in which enacted, if House Bill 3479 or similar

13  legislation amending s. 215.32, F.S., to authorize transfers

14  from the Working Capital Fund to the Agricultural Emergency

15  Eradication Trust Fund by the Comptroller, is adopted in the

16  same legislative session or an extension thereof.
