  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         20.1655, F.S.; creating the Tobacco Pilot

  4         Program Trust Fund within the Department of

  5         Business and Professional Regulation; providing

  6         for sources of moneys and purposes; providing

  7         for annual carryforward of funds; providing for

  8         future review and termination or re-creation of

  9         the trust fund; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Section 20.1655, Florida Statutes, is

14  created to read:

15         20.1655  Tobacco Pilot Program Trust Fund.--

16         (1)(a)  The Tobacco Pilot Program Trust Fund is hereby

17  created within the Department of Business and Professional

18  Regulation. Funds to be credited to the trust fund shall

19  consist of any portion of the $200 million received by the

20  state from settlement of State of Florida v. American Tobacco

21  Co., Case No. 95-1466AH, in the Circuit Court for the

22  Fifteenth Judicial Circuit, in and for Palm Beach County,

23  Florida, and deposited under s. 17.41(1)(a), that are

24  appropriated pursuant to legislative appropriation or an

25  approved amendment to the department's operating budget

26  pursuant to the provisions of chapter 216. Funds shall be used

27  as appropriated for the purpose of conducting the pilot

28  program described in the settlement.

29         (b)  Notwithstanding the provisions of s. 216.301 and

30  pursuant to s. 216.351, any balance in the trust fund at the

31  end of any fiscal year shall remain in the trust fund at the

  1  end of that year and shall be available for carrying out the

  2  purposes of the trust fund.

  3         (2)  Pursuant to the provisions of s. 19(f)(2), Art.

  4  III of the State Constitution, the trust fund shall, unless

  5  terminated sooner, be terminated on July 1, 2002.  However,

  6  prior to its scheduled termination, the trust fund shall be

  7  reviewed as provided in s. 215.3206(1) and (2).

  8         Section 2.  This act shall take effect July 1 of the

  9  year in which enacted.
