  1                      A bill to be entitled

  2         An act relating to the Florida Clean Indoor Air

  3         Act; amending s. 386.205, F.S.; reducing the

  4         percentage of seats required to be in an area

  5         designated as a smoking area in certain

  6         restaurants; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Subsection (4) of section 386.205, Florida

11  Statutes, is amended to read:

12         386.205  Designation of smoking areas.--

13         (4)  No more than one-half of the total square footage

14  in any public place within a single enclosed indoor area used

15  for a common purpose shall be reserved and designated as a

16  smoking area.  This square footage limitation does not apply

17  to restaurants as defined in s. 386.203(1)(p). However, such a

18  restaurant must ensure that no more than 35 65 percent of the

19  seats existing in its dining room at any time are located in

20  an area designated as a smoking area.

21         Section 2.  This act shall take effect upon becoming a

22  law.

25                          HOUSE SUMMARY

      Reduces from 65 percent to 35 percent, the percentage of
27    seats existing in a dining room of a restaurant which
      seats more than 50 persons which must be located in an
28    area designated as a smoking area.
