1 A bill to be entitled
2 An act relating to the Cities of Deerfield
3 Beach and Pompano Beach, Broward County;
4 extending and enlarging the corporate limits of
5 such cities to include specific unincorporated
6 lands within the corporate limits of said
7 cities; providing for transfer of public roads
8 and rights-of-way, and responsibilities
9 thereof; providing exceptions; providing for a
10 referendum; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. (a) Upon the effective date of this act,
15 Broward County, at the direction of the Broward County
16 Legislative Delegation, shall have directed a study of all the
17 properties described in subsection (c) of this act as area 1.
18 The study shall determine the effects of annexation of such
19 area into the Cities of Deerfield Beach and Pompano Beach,
20 including the effects of annexation on the employees of
21 Broward County and how to ameliorate same, and the economic
22 impact of the area upon annexation to either the City of
23 Deerfield Beach or the City of Pompano Beach. The study shall
24 be performed by an independent agency or educational institute
25 not affected by or associated with the proposed annexation as
26 determined by the Broward County Legislative Delegation and
27 shall be completed not later than July 1, 1998. The cost of
28 the study shall be borne by the county, which shall be
29 responsible for printing and distribution of the study not
30 later than August 1, 1998.

1 (b) The Board of County Commissioners of Broward
2 County shall schedule an election, in accordance with the
3 provisions of law relating to elections currently in force in
4 the county, on November 3, 1998. The purpose of the election
5 shall be to determine the annexation of the area into either
6 the City of Deerfield Beach or the City of Pompano Beach. Only
7 registered voters residing in the area described in subsection
8 (c) may vote in said election.

14 (d) The majority vote of the voters as provided in
15 subsection (b) shall determine into which municipality the
16 unincorporated lands described in subsection (c) shall be
17 annexed, and said unincorporated lands shall become a part of
18 the elected municipality on January 1, 1999, pursuant to s.
19 171.062, Florida Statutes.
20 Section 3. Notwithstanding the provisions of s.
21 335.0415, Florida Statutes, all public roads and the public
22 rights-of-way associated therewith, lying within the limits of
23 the lands subject to annexation or incorporation herein, as
24 described in sections 1 and 2, are transferred from Broward
25 County jurisdiction to the jurisdiction of the annexing or
26 incorporating municipality, except those portions of Copans
27 Road, Military Trail, and N.E. 48th Street lying within the
28 limits of the annexation area. All rights, title, interests,
29 and responsibilities for any transferred roads, including, but
30 not limited to, the operation, maintenance, planning, design,
31 and construction of said roads, and the rights-of-way

1 associated therewith, shall transfer from Broward County
2 jurisdiction to the jurisdiction of the annexing municipality
3 upon the effective date of this act.
4 Section 4. The provisions of sections 1, 2, and 3 of
5 this act shall take effect only upon the approval by a
6 majority vote of those qualified electors of Broward County
7 residing within the boundaries of area 1 and area 2,
8 respectively, and voting in a referendum election to be called
9 by the Board of County Commissioners and to be held on
10 November 3, 1998, in accordance with the provisions of law
11 relating to elections currently in force, except that this
12 section shall take effect upon becoming a law.
