2 An act relating to the Commission on Ethics;
3 amending s. 112.321, F.S.; revising criteria
4 for appointment of members to the commission;
5 defining the term "cause"; providing an
6 effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (1) of section 112.321, Florida
11 Statutes, is amended to read:
12 112.321 Membership, terms; travel expenses; staff.--
13 (1) The commission shall be composed of nine members.
14 Five of these members shall be appointed by the Governor, no
15 more than three of whom shall be from the same political
16 party, subject to confirmation by the Senate. Two members One
17 member appointed by the Governor shall be former elected or
18 appointed local governmental officials or employees, who may
19 be former members of a local planning or zoning board which
20 has only advisory duties. One member shall be an attorney
21 with trial bar experience a former city or county official and
22 may be a former member of a local planning or zoning board
23 which has only advisory duties. Two members shall be
24 appointed by the Speaker of the House of Representatives, and
25 two members shall be appointed by the President of the Senate.
26 Neither the Speaker of the House of Representatives nor the
27 President of the Senate shall appoint more than one member
28 from the same political party and one member appointed each by
29 the Speaker of the House of Representatives and the President
30 of the Senate shall be a former local or state governmental
31 official or employee, who may be a former member of a local

1 planning or zoning board which has only advisory duties. No
2 member may hold any public employment. All members shall
3 serve 2-year terms. No member shall serve more than two full
4 terms in succession. Any member of the commission may be
5 removed for cause by majority vote of the Governor, the
6 President of the Senate, the Speaker of the House of
7 Representatives, and the Chief Justice of the Supreme Court.
8 The term "cause" may include nonattendance at two or more
9 consecutive official meetings.
10 Section 2. This act shall take effect upon becoming a
11 law.
