2 An act relating to Indian River County;
3 amending chapter 79-480, Laws of Florida;
4 providing for certain restrictions on the
5 harvesting of shellfish; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Paragraphs (a) and (b) of subsection (1) of
11 section 1 of chapter 79-480, Laws of Florida, are amended to
12 read:
13 Section 1. Indian River County; restricted areas for
14 harvesting shellfish oysters; penalty.--
15 (1)(a) It is unlawful for any person to harvest
16 shellfish oysters in Indian River County, whether such
17 harvesting be for private use, commercial sale, or for
18 out-of-season relaying, from any submerged public or private
19 land which is within 75 feet of the shoreline of the Indian
20 River or of from any canal bank, or which is within 75 feet of
21 any privately owned submerged land, or any dock, in Indian
22 River County without first obtaining written permission from
23 the owner of the adjacent public or private property or dock
24 which is within 75 feet of the shoreline of the river or which
25 directly borders any such canal.
26 (b) With respect to the harvesting of shellfish
27 oysters from any canal in Indian River County the owner of the
28 property abutting the canal shall be deemed to have
29 jurisdiction to the midpoint of the canal for the purposes of
30 granting permission for any such harvesting.
