3 children; creating s. 787.035, F.S.; defining
4 the offense of knowingly encouraging, aiding,
5 abetting, or conspiring with a child to run
6 away from home, or knowingly harboring a
7 runaway child; providing penalties; defining
8 "harbor" and "home"; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 787.035, Florida Statutes, is
14 created to read:
15 787.035.--(1) Any person who knowingly encourages,
16 aids, abets, or conspires with a child to run away from home
17 or knowingly harbors a child who has run away from home
18 commits a misdemeanor of the first degree, punishable as
19 provided in s. 775.082 or s. 775.083.
20 (2) For the purposes of this section:
21 (a) "Harbor" means to keep secreted, cohabit with, or
22 provide shelter for any minor without the consent of the
23 parent, legal guardian, legal custodian, Department of
24 Children and Family Services or Department of Juvenile
25 Justice, or other person having legal custody of such minor.
26 (b) "Home" means the child's place of residence,
27 including the home of any parent, legal guardian, or legal
28 custodian or a Department of Children and Family Services
29 shelter or foster home, a Department of Juvenile Justice
30 shelter, or a state-approved or court-ordered shelter or
31 crisis intervention facility.

1 Section 2. This act shall take effect October 1, 1997,
2 and shall apply to offenses committed on or after that date.
