  1                      A bill to be entitled

  2         An act relating to specified exceptions from

  3         dual office holding requirements for certified

  4         officers; creating s. 943.1398, F.S.; providing

  5         that a person employed as a law enforcement

  6         officer, correctional officer, or correctional

  7         probation officer may be employed on a

  8         part-time basis by a different employing agency

  9         without being considered to be holding an

10         "office" for certain purposes; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

15         Section 1.  Section 943.1398, Florida Statutes, is

16  created to read:

17         943.1398  Specified exceptions from dual office holding

18  requirements.--A person who holds active certification from

19  the Criminal Justice Standards and Training Commission as a

20  law enforcement officer, correctional officer, or correctional

21  probation officer, as defined in s. 943.10(1), (2), (3), (6),

22  (7), (8), or (9), and who is employed or appointed by an

23  employing agency as defined in s. 943.10(4), may be employed

24  on a part-time basis by a different employing agency without

25  being considered as holding an "office" for the purposes of s.

26  5(a), Art. II of the State Constitution.

27         Section 2.  This act shall take effect upon becoming a

28  law.
