17 and insert:
18 (4) (a) The consent to an adoption or affidavit of
19 nonpaternity shall not for voluntary surrender must be
20 executed before after the birth of the minor.
21 (b) A consent to adoption of a minor who is to be
22 placed for adoption under s. 63.052 upon the minor's release
23 following birth from a licensed hospital or birth center,
24 shall not be executed sooner than:
25 1. 48 hours from the time of the minor's birth; or
26 2. The day the birth mother is determined in writing,
27 either on a patient chart or in release paperwork to be fit
28 for release from a licensed hospital or birth center;
29 whichever is sooner.
30 A consent executed under this paragraph is valid upon
31 execution and thereafter may only be withdrawn when the court

1 finds that it was obtained by fraud or under duress.
2 (c) When the minor to be adopted is not placed under
3 s. 63.052 upon the minor's release following birth from a
4 licensed hospital or birth center, the consent may be executed
5 at any time after the birth of the minor. While such consent
6 is valid upon execution, it is subject to a 3-day revocation
7 period under subsection (7).
