2 An act relating to fines; amending s. 939.017,
3 F.S.; providing that fines collected for
4 misdemeanor convictions involving drug or
5 alcohol shall be forwarded to the
6 jurisdictional county of collection rather than
7 to the Department of Health and Rehabilitative
8 Services; providing for the deposit of such
9 fines in the local County Alcohol and Other
10 Drug Abuse Trust Fund; repealing s.
11 397.321(20), F.S.; conforming to the act;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Paragraph (b) of subsection (1) of section
17 939.017, Florida Statutes, is amended to read:
18 939.017 Misdemeanor convictions involving drugs or
19 alcohol; additional costs.--
20 (1)
21 (b) The clerk of the court shall collect the $15 and
22 forward $14 thereof to the jurisdictional county of collection
23 as described in s. 893.165(2) Treasurer to be deposited to the
24 credit of the County Alcohol and Other Drug Abuse Trust Fund
25 Department of Health and Rehabilitative Services for
26 allocation to local substance abuse treatment programs under
27 s. 893.165 s. 397.321. The clerk shall retain the remaining
28 $1 of each $15 collected as a service charge of the clerk's
29 office.
30 Section 2. Subsection (20) of section 397.321, Florida
31 Statutes, is hereby repealed.
