  1                      A bill to be entitled

  2         An act relating to water and wastewater

  3         systems; amending s. 367.171, F.S.; including

  4         Flagler County within a list of counties

  5         excluded from the provisions of the Water and

  6         Wastewater System Regulatory Law; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (3) of section 367.171, Florida

12  Statutes, 1996 Supplement, is amended to read:

13         367.171  Effectiveness of this chapter.--

14         (3)  In consideration of the variance of powers,

15  duties, responsibilities, population, and size of

16  municipalities of the several counties and in consideration of

17  the fact that every county varies from every other county and

18  thereby affects the functions, duties, and responsibilities

19  required of its county officers and the scope of

20  responsibilities which each county may, at this time,

21  undertake, the Counties of Alachua, Baker, Bradford, Calhoun,

22  Charlotte, Dade, Dixie, Escambia, Flagler, Gadsden, Gilchrist,

23  Glades, Hamilton, Hardee, Hendry, Hillsborough, Holmes, Indian

24  River, Jefferson, Lafayette, Leon, Liberty, Madison, Manatee,

25  Okaloosa, Okeechobee, Polk, St. Lucie, Santa Rosa, Sarasota,

26  Suwannee, Taylor, Union, Wakulla, and Walton are excluded from

27  the provisions of this chapter until such time as the board of

28  county commissioners of any such county, acting pursuant to

29  the provisions of subsection (1), makes this chapter

30  applicable to such county or until the Legislature, by

  1  appropriate act, removes one or more of such counties from

  2  this exclusion.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
