Florida House of Representatives - 1997 HB 569 By Representative Merchant 1 A bill to be entitled 2 An act relating to Palm Beach County; amending 3 ch. 93-367, Laws of Florida, as amended; 4 revising provisions relating to employees of 5 the Palm Beach County Sheriff; limiting 6 benefits to employees beyond the rank of 7 captain; deleting a provision which preserves 8 current benefits when a new sheriff takes 9 office; providing for construction; providing 10 an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 3 of chapter 93-367, Laws of 15 Florida, as amended by chapter 96-450, Laws of Florida, is 16 amended to read: 17 Section 3. Preservation of employment benefits and 18 emoluments.-- 19 (1) The provisions of this section shall apply to all 20 certified and noncertified persons in the employ of the 21 Sheriff of Palm Beach County, including deputy sheriffs, as 22 specified in section 1(2)(a) of chapter 93-367, Laws of 23 Florida, except that this section shall not apply to those 24 employees beyond the rank of captain or its civilian 25 equivalent. 26 (2) Whenever a new sheriff takes office, the sheriff 27 shall preserve current employment benefits and emoluments 28 during the remainder of that fiscal year or 6 calendar months, 29 whichever is greater. 30 (2)(3) At all other times, Existing employer-paid 31 benefits and emoluments with regard to the pay plan, longevity 1 CODING: Words stricken are deletions; words underlined are additions. Florida House of Representatives - 1997 HB 569 514-150-97 1 plan, tuition-reimbursement plan, career-path program, health 2 insurance, life insurance, and disability benefits may not be 3 substantially reduced, except in the case of exigent 4 operational necessity. 5 (3)(4) Nothing in this act shall preclude the sheriff 6 from enhancing those benefits and emoluments for employees and 7 appointees of the Palm Beach County Sheriff's Office. 8 (4) Nothing in this act shall be construed as 9 affecting the budget-making authority and power of the Palm 10 Beach County Board of County Commissioners. 11 Section 2.
