1 A bill to be entitled
2 An act relating to the death sentence; amending
3 s. 922.10, F.S.; requiring that the Department
4 of Corrections contract with a private vendor
5 for the purpose of carrying out executions;
6 providing for the vendor to designate the
7 executioner; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 922.10, Florida Statutes, is
12 amended to read:
13 922.10 Execution of death sentence; executioner.--A
14 death sentence shall be executed by electrocution. The
15 Department of Corrections shall enter into a contract with a
16 private vendor for the purpose of carrying out executions. The
17 private vendor The warden of the state prison shall designate
18 the executioner. Information that which, if released, would
19 identify the executioner is confidential and exempt from the
20 provisions of s. 119.07(1) and s. 24(a), Art. I of the State
21 Constitution. The warrant authorizing the execution shall be
22 read to the convicted person immediately before execution.
23 Section 2. This act shall take effect upon becoming a
24 law.

27 SENATE SUMMARY
28 Provides for a private vendor to execute persons
sentenced to death in this state pursuant to a contract
29 with the Department of Corrections. Requires that the
vendor, rather than the warden of the state prison,
30 designate the executioner.
